I have a 3ds on gateway 9.x emunand. can i play mario party with my sisters legit 3ds using download play?

You should be able to. I did so with my brother when I was on firmware 6 or 7 emunand.

You can download play just fine, assuming the game region and the region of the receiving 3DS is the same.

In other words you can use a USA copy of Mario Party to Download Play with a USA region console, no matter what region console the GW is being used on.

I think you'll be disappointed by Mario Party 3DS if you've played other Mario Party games before though. Mario Party DS is actually a lot better, although the 3DS version isn't exactly bad either it's nowhere near as good.

Basically, it isn't Mario Party. Think Wii Party, but with a Mario sticker plastered over the top.

It's a hollow experience.
