Why would a company take an action that destroys their sales for absolutely no gain? Apple doesn't care about market share. When you're the monopoly, every action you take is highly scrutinized as an anti-competitive practice. They don't want to be held back by the legal system and become the next Microsoft.
They wouldn't; nor would I expect them to. I'm not interested in the company in this particular instance, though.
I'm just saying that I think OS X makes for a nicer operating system than Windows and it'd be nice to be able to use it legally, without having to pay the so-called Apple tax.
If only Apple were primarily just a software company.

If Apple were just a software company they wouldn't be where they are today. Most likely wouldn't even exist. If they did, the platform would be at a huge detriment and not the OSX we know today.

In addition, contrary to what many think, installing OSX on a non-Apple machine is not actually illegal under any US law.

They definitely wouldn't be where they are today, but I think they'd still exist. If they were direct competition for Microsoft back in the day, they would've probably had the edge in the PC market.
I'm under the impression that Apple's developers have always been more competent than Microsoft's, but that's another debate.

They were direct competition with Microsoft from the very start. Apple started as the big player and then got toppled by Bill Gates' superior market strategy.

Addressing your second comment: it really has little to do with the developers. Both companies have innumerous amounts of talented programmers and UI/UX specialists. The difference is in management. With Apple you have vision: almost everything stems from one source at the top. Microsoft is a much more fragmented company whose power and focus is distributed among an almost equally innumerous group of managers and others who aren't directly tied to the creation of the product. The development strategy of the latter generally boils down to "what do our enterprise customers say we can't do, what does our legal department say we can't do, what do our focus groups say we can't do, okay let's add window transparency."
