Wait, are you a developer? A beta tester? The Switch released March 3rd 2017. It's not even 2.5 years, let alone 3. Unless you somehow got an early pre-release system?
Also, if you use emuNAND (SXOS, or Atmosphere in the near[ish] future), and only use emuNAND offline, you can use homebrew on emuNAND (in permanant airplane mode. Or at least with a protected DNS [aka 90dns or whatever it's called], as some homebrew supports online play with other homebrew). Then, if you want to play online, you use your sysNAND (no homebrew). As long as you keep the two distinctly seperate, you should be able to homebrew without bans.
Though, apparently if you're careful (no installed NSPs, no obvious save-game edits, no obvious cheats, and likely more), you can run Atmosphere (and most homebrew) without drawing Nintendo's attention (and therefore bans). But keep in mind anything can happen, and you might get banned anyway.
