    I personally use atmosphere to run smash mods, backup saves and screw around with whatever homebrew looks interesting to me.
    Custom themes and game modding are "legit" uses for Atmosphere/CFW without piracy.

    I take issue with "the percentage of people that don't use it for piracy are moot." We exist, and even if many users do use Atmosphere for piracy, it's not the only purpose or the intended one.

To sit there and say I am one of the few is pretty much the definition of moot. At least you are (maybe) not running nsp/xci "backups" and then pushing the moot point. Then you'd be a hypocrite too, You may have a right to be offended but you are probably intelligent enough to know a generalization when you see one. I know you are jumping on the bandwagon and all but don't ask me to expect that people on here aren't full of it. Around here HALF of the users "NEVER PIRATE" LOL sure. Forgive my skepticism. But if it's hanging out with a bunch of ducks it might be a fuckin duck. Just sayin'. My statements stand. Congrats if you are the exception. You are DEFINATELY not the rule.

    Here on GBAtemp it is quite simple: Anything you have to pay for is illegal and bad people who copy everything, everything that is free for them to leech and use is legal and the people are creative heroes who need their ass kissed so they give them more free and 'legal' stuff.
    That will prevent you from reading 200 post from people who suddenly became legal advisers :)

    Im surprised by the number of people that blindly say yes. You break nintendos terms of service by using their products, but how can you claim a website thats been selling merchandise for years illegal?

    Yep. Lots of stolen code and whatnot, from what I understand. While I've used it before (and it had its perks), I too ran into the same situations you described. A lot of people in the Switch homebrew and development scene feel that SXOS is bad in a lot of ways, and many will tell you NOT to use it, often for the above reasons, and some will even outright ban you JUST for mentioning that you use it. Some homebrew was even designed to look for signs of SXOS on your system, and either warn you that this software may not work as intended (or just outright exit). They have their reasons for doing this, and while some of their responses to SXOS use may seem questionable (or even downright hostile, as I've witnessed), it's best to just take their advice, and dump it entirely.

    There are better, free alternatives, and these even often update in a timely manner whenever Switch firmware updates release. I highly recommend Atmosphère. It's compatible with most homebrew and isn't too difficult to set up. Best of all, it's free. You may need sys patches to run your game backups, though.

    Speaking of which, Atmosphère was just updated again yesterday, and adds a lot of new features and bug fixes, and the biggest thing that excites me is the addition of "Daybreak," a new homebrew app that uses the new "am:su" system updater API to allow upgrades and even downgrades. It's touted as safer alternative to ChoiDuJour. There's even tentative partial support for Mariko units (though they warn you not to run AMS on them just yet. Their project roadmap was also added, and it looks like they have a lot of plans for the remainder of the summer.

    The answer to this question is, and always has been, "it depends on your jurisdiction". iPhone users won their exception to the DMCA and are legally allowed to jailbreak their phones as long as they don't use their newly acquired freedom to pirate, console gamers do not have that luxury. Cases like this are decided differently in different countries, but according to the letter of the American law you're violating copyright as soon as you've installed any modification to the original software because doing so necessitates bypassing the built-in protections. It's just the way it is, people need to lobby the Congress if they want to see this unfair legal situation changed.

    Was it the Nintendo Homebrew discord? They are heavily anti piracy and even mentioning anything vaguely piracy related, like sig patches, will make people not help you.

    Thanks for the detailed response. Atmosphere is definitely my first choice since it's free, but my desire to have homebrew on my Mariko unit outweighed my desire to use atmosphere. I've tried both on an old switch and there are definitely pros and cons to either. The emunand from SXOS is pretty legit in avoiding bans. I'm not sure if the Atmosphere emunand-or emumcc thing-is quite as fail proof. However atmosphere allows sys-patches so things like over locking are possible, not to mention you can actually get support.

    Theres really nothing gray about it. Sxos is intended for full blown piracy. If you only want homebrew its a waste of money to buy the sxos regardless of its backstory and its illegal methods. That should have been the go to answer for your decision, but here we are on the 5th page lol

    sx os is no different to any other exploit as it all allows piracy, you could be like me and use sx os and other exploits but sill only play legit game carts and use sx os for its homebrew functions such as emulation and cheats.

    Actually it is different in a point of view. Atmoshere by default does not have the ability to play pirated content. Only the end-user can make that happen if he/she chooses to providing sigpatches, while the sxos comes prepacked with sigpatches or in the anti sxos user terms stolen keys thats what brings up the illegal bit.

    if someone steals your tv, it means you no longer have access to it, but code (and games, music, movies, etc) can be infinitely copied without degrading, even if SXOS exists it doesnt mean atmosphere stopped existing, its an asshole thing to sell someone else's work while claiming it to be yours, but it isnt theft
