If you move a user from a hacked switch to a non-hacked switch can the non-hacked switch get banned?

I want to move my user to a new switch so I can keep my saves but I am worried of getting banned. I have tinfoil installed on my hacked switch if that matters

Nintendo bans devices, not users. It doesn't make sense for them to ban people because people have the spending power. They want your money.

If my profile has save data from games installed with Tinfoil that aren't on my switch will my new switch be banned if I bring it over or will it be fine

Not sure how you would bring saves from a hacked switch to a unhacked switch. I've never done it before, so assume that without hacking both, you'll have to use the Nintendo cloud service to transfer the saves. In doing so, you'll probably get the currently hacked switch banned. But if you managed to get that done, I would assume that the unhacked switch will be ok. Looks like some other people are trying the same thing:

There is a chance of a ban.

Simple: If you used cheats or edited the save file to get stuff you can't get in a normal playthrough. It could be flagged if you ever go online with it, even if the save was transfered to a non hacked Switch.
