Here's what I would do.

1.Sneak in to his room, when you get the chance.

2.Swap your controller for his.

3.Leave like every things normal.

4.Engrave, or mark your stuff. (Your controller)

5.Without your brother knowing show, and tell you mom about your plan.

6.Put the controller in your room, and leave for a little while.

7.Your brother sneaks in, and swaps the controllers again.

8.Show, and tell your mom your controlller doesn't have your marking on it.

9.Have your mom go into your brothers room, and get your controller.

10.She'll see the mark you showed her before, your brother gets caught.

No fail.

It still doesn't prove his brother originally took the controller.

You're suggesting the OP tells his mum he's taken the controller from his brothers room and swapped them. The mum already thinks the controller in the brothers rooms is the brothers controller, so all teh OP will do is get in more trouble.

OP: Sneak in and add the marking, then tell your mother that he has your controller.

No, I was suggesting that he pretend that the controller he swapped was his brothers here is a better clearer scenerio.

His brother has his controller, and it's in his room. He has his brothers controller.
He goes into his brothers room, and swaps his brothers controller for his own controller.
He sneaks out of his brothers room, and goes into his own room, and marks the controller.
He goes to his mom, and says "Mom, I marked my controller with a X. So if he has a controller with a X, on it. It's mine."
He places the controller in his room, and leaves.
His brother goes into his room, and takes the controller marked with a X, and leaves the other one.
He goes into his room, notices his controllers been swapped, and tell his mom.
His mom goes into his brothers room, and takes the controller, and looks for the X.
She finds the X, and believes that his brother took his controller.
His brother is punished.

I doubt that would work either.

QUOTE(Skullcollector @ May 29 2010, 12:35 PM) Hehe! I would do that but he locks his door when he's away and anyway he is in his room 24/7.

It was already 2 days ago, could be a while before he manages to mark it.

If he then goes and tells him mum, his mum will say something like: If he stole your Controller and it was marked, why didn't you say it was marked when you first said he stole it? She will think he's more of a liar and believe him less.

If it was marked and his mum banned him from the xbox, then he have said something about it being marked to his mum at the time.

True. What I would do is make some excuse on why I didn't remember I marked it. Or why i just now remembered.

"Hey, mom. I remembered, that when I took my XBOX to my friend *****'s house that I marked it so that we didn't confuse his controllers with mine." "Can we check my brothers controller to see if he has mine?"

Help your mother and father in a lot of work and stuff that will help them a lot! you will earn their trust and you say anything they will believe you. I earned mines =D life is much easier now.
