Nintendo has two 3.3U firmware updates, right? I think I have the earlier one, but I'm not sure. How would I make sure? Also, what are all the legit things I can't do since I haven't updated? Besides being able to access the Shop and Nintendo Channels...

If you haven't updated since October (or accessed the shop channel), you have the original. The newer 3.3 update came on October 23rd.
Otherwise, there's no standout identification like there is with the 3.4 update or whatnot.
You can install just the WAD for having the updated shop channel or 3.4's Mii update without doing full updates - see wiibrew.org for that.
