Hacking h-encore vita 3.68 no enso and PS Store question

Since my vita does not have enso on it and I have to install h-encore if I reboot/shutdown my vita, would I be correct in assuming that my vita is technically not hacked after a reboot/shutdown until I run h-encore install? Reason I ask, I would still like to access the ps store to download the library I already own. Do I have to worry about being banned if I access the store? Also, I am using SD2Vita, will I have any issues installing running the games?

AFAIK, Sony never banned anyone (right?). So don't worry even with a hacked vita.
