Apparently they do. Streetpass requires it as proven with people not getting the Eon Ticket with a .3ds

According to the following post, Streetpassing shouldn't require a header:

Yes, but as a general rule region-free local multiplayer is an exception.

but SSB isn't. That's why I said it is entirely dependant on the games.

Few people in my eon ticket thread confirmed street pass did not work unless using a 3dz now maybe a 3dz without a header works but still needs to be 3dz
