Well, this is probably not going to end well. Nintendo took down the Github repo for Freeshop. Freeshop is a 3DS homebrew that allows the installation of 3DS games and apps through Nintendo's own servers for free, made by @TheCruel. The Titlekey websites that Freeshop relies on will probably come down soon as well.

Can't say I'm terribly surprised. Its pretty much the most unapologetic homebrew app there has ever been. It serves one function that Nintendo quite understandably would be completely against. Still it is sad to see such a thing.

Except for the part where it did not have any titlekeys (even funnier is that it did illegally mirror game icons, but they're on a separate repo not mentioned)

acutally, freeshop does not contain any copyright material. you have to get the files yourself and enter in that title key site into the auto update url manually.

Legally their argument is invalid. Unless I'm mistaken, freeShop is using the inbuilt 3DS method to install files, like the Wii and Wii U installers do, so they can't come attack him.
Well they claim freeShop circumvent their security, and this is prohibited. And it does by forging tickets.
Also it uses those damn fine logos of them.

Sure, but without those titlekeys, the app is completely useless. Like I said the app serves one purpose, how you go about to make it happen is irrelevant. Fact is, Nintendo may well try and DMCA the title keys website as well, wouldn't be surprised. The both work together to do something Nintendo would never want you to.

I don't really understand what you're arguing here. All my point is, is that its completely understandable why this would be one of (if not the) top targets for Nintendo to take down in relation to the 3DS homebrew scene. It sucks, but I get it.
