Abandonware isn't usually legal actually. It just has a lack of people causing problems. It still breaks copyright laws

It's more like the companies owning the content eventually shut down or are bought up by other companies. This ends up with some programs and stuff people think they can just upload because there's a lack of people keeping track. Which technically they can, with a low chance of repercussion, but it's not legal unless the copyright on the content has run out. Atleast as far as I know.
If a company makes something of there's free for the taking that's different though

Not necessarily. Abandonware simply refers to programs that are ignored or "unrecognized" by whomever owned the rights and that's it, it doesn't necessarily mean it's free for anyone to download, as the copyright for the product is (in nearly every case) still valid. You'd still be violating copyright laws by downloading the software without paying.

However, when a software is considered abandonware, the chance of having the owners track copyright violation is basically none, so it's conceived as "ok to pirate" since there are no risks of legal issues.

As a side note, Windows 98 is not abandonware, as Microsoft still acknowledges the OS exists and is their product. They may not support it anymore, but that's not to say they abandoned it. It's also not "legal to download and use it for free", you still need to buy a Windows 98 license key to have what would be considered a "legal" copy. Anything else is illegal.

How do I get them back ? I have them on Payment History but I had them for free on January 3 2020. And I have order id numbers for two of them.. Even thought they are free for me. How do I get them back if I deleted games and didn't save on my hard drive ?

You should be able to redownload them. If not email their support with screenshots of your email reciepts and that should take care of it
