Do we even know if that request letter is legit? I've seen fake ones before. I'm guessing someone from 3DSLink/R4i Super Mega Ultra Deluxe Vanilla Hookah RTS 3DS sent it.

Likely due to gateway-3ds.com making filetrip the sole link to download the file: http://www.gateway-3ds.com/downloads.html

Crap, that's not good. People buying a GW will be screwed now for a few days until Gateway sort it out.

I know fake ones exist but I didn't think about the fact that it might be a fake one from r4ids.cn.
I guess the only way to know for sure is to give Nintendo a call and ask. They'd have to find the right representative to talk to though.

You know when a thread discusses the non posting of links to gateway d/ls , i would have assumed people dont actually do it in the thread discussing it. :)
Costello said as long as it isn't a direct link, it's fine. That's not a direct link.

The link goes to the official gateway download page, which links back to the filetrip page for the file, which has been taken down. Not a lot of direct linking going on there :)

There's a difference in legal terms of individual users posting external links and gbatemp hosting files directly also, but happy for mods to take down whatever they feel inappropriate.

the whole existence of this website/forum and it's content is questionable, they chose to pick on the gateway.

Anyway bad news for filetrip but hopefully it can be adjusted to in a few months when we see more clones and all

Umm educate me too, the DMCA is specific to the US right? if so, aren't the servers in France so would the DMCA apply there?

I am not seeing the questionable nature of the forum, granted there is easily enough rope to hang ourselves with a few small changes but everything is very deliberately managed to keep things very much on the right side of what is free speech and the like.

The internet is a jurisdictional nightmare at the best of times. The US has a nasty habit of throwing its weight around though and even if it was not it is not like it is a big part of the forum that is lost and the time it would take to speak a competent enough legal type would probably cost more than a hosting for a couple of months (there is a phrase in these types of cases that reads "the only people to win are the lawyers").

Sensei fast, i think u need to slow down and break ur sentences bcz they are quite difficult to read lol.

a major portion of the ppl visiting the forums IMHO are pirates even if they talk about something other than roms and hacking.
however the forum has become what it has bcz it is able to incorporate many other things after it's attracting of the pirate pop.

I'm not sure whether AP circumvention is indeed a copyright infringement, let alone according to hoster's country (France?) laws, but if it's that big of a deal, maybe this thread should be stickied or something.

I'm more concerned about them turning this into an even more restrictive matter - arguing that such content should be treated the same way as warez - in other words up to the point where users have to refrain from even mentioning the product or linking to the website in the same manner in which torrent and romsites are handled.

What I'm wondering is why recent 3DS ds-mode flashcarts aren't banned. Don't they contain bootloader code of games? IIRC I remember reading the Cyclo DSi used Cooking Mama or some cooking game to boot, meaning it contained copyrighted code.

As for the download, Gateway has new download links up, and a reupload on Filetrip.

LOL.

About the DS flashcard, I guess Nintendo don't give a damn about the DS anymore.

But you had to download the ROMs for the Bootstrap yourself. You got a blank card.

Yeah I found it humorous too :P

And I guess, but even when these first came out with DSi-mode, nothing was done.
With DSi firmware 1.4.3 to 1.4.4, the CycloDS iEvo and the other exploit got banned by nintendo. The DS mode of the iEvo got blocked after 1.4.2.

It's probably fake, I'd say the appearance of clones and this is too well aimed together. It's likely one of the clone teams trying to blacken the Gateway and make its' possible buyers jump ship. If not, could you post the rest of the letter including the details of who sent it? (I'm sure many would like to send them some... "thank-you" emails)

Besides, even if it's legit, the letter only told you to remove the current Gateway files. It said nothing about not uploading 2.0 files when they're out (given that it'll probably have a cartridge backup feature, making it defendable as a legal application).

Lol GW is getting battered! 3DS Link is the way forward; can't you see, Gateway is dieing!

Let me point out a couple of typographical errors that shouldn't be here if this were a real legal letter:

"I am authorised to act on behalf Nintendo"
Behalf Nintendo? Really? Should read "Behalf OF Nintendo"

"remove or disable access to the Infringing Materials listed at the URLs below and in order to prevent further legal actions against your company."
There shouldn't be an "and" here in this sentence.

Does anyone think a respectable and REAL legal firm would have typos like this?
Now maybe that sentence structure makes sense somewhere outside of the US, but if it does I'm not aware.
