Everything will be at that point on which your old backup was. If you downloaded games in the meantime, you need to redownload them from the eShop.

No, the games are bound to your eShop account. And the eShop account is stored at the servers of Nintendo.

If you don't get banned you get to keep your account and redownload your games, and a nand backup won't fix a ban it can only help prevent

I believe account balance and purchases are handled on a server side, not on a local level on your console. Which means that NAND backups won't do much.
However, if your switch gets banned your account likely will get banned, or it might pose a high risk if linked to an unbanned switch. Not something I would recommend anyone doing.
