Guess what? You totally miss the point. Lol
Even if someone finds kernel exploit and tries to sells it,no one would buy it from them. Why?
Just think about it for a little while ;)
I assure you people will still buy it. Just because one person found it doesn't mean that everyone else will instantly find it at the same time. It could just be extremely elaborate like making people send over their 3DS to downgrade it. I can assure you, people will still pay for it.

i'd rather have all the power in the hands of a morally sound person, than distributed in everyones filthy little pws

What kind of morally sound person's actions force a small company out of the eShop for months and causes lost revenue and extra money spent to fix their game?

On topic:
Hopefully someone figures out how to get eShop access on lower firmwares. A quick google search brought up someone on reddit saying: "It's probably NNID, not eshop, that is blocked. You can still get on the eShop if you don't have an NNID linked to the console in question."

If that's true, HANS probably isn't going to give us a solution, but since access is granted on 10.2, and access was possible on both 10.2 and 9.9-10.1 at some point in time, I guess something can be done about it on userland.

Enough of that nonsense rambling. Sorry.

Didn't plan on replying because I don't know how to significantly contribute to the topic at hand, but dude... that's depressing, I feel sorry for the Ironfall developers now. ; - ;

My point is whenever Gateway is, cfw lurks around. Why buy Gateway( if ever it supports 9.3+ systems ) when cfw does the same and more?
Yes, some people will still buy Gateway. But not enough people to make profit out of them.

Why can't we have normal Homebrew developers who can release Kernel Exploits like any normal person would?
Piracy my a**, People want em CFWs and boosts because of a Kernel Exploit.

Also don't tell me that Kernel Exploits take a lot of work, of course I know they do, but come on, we ALL know one of these Exploit makers has one up their sleeve.

It's not as simple as you make it out to be, look at the scene for other consoles... we got the Jtag hack for the Xbox 360 around 4 years after the console was released, it then took another few years for the RGH hack to be released.

Kernel exploits do not grow on trees, so we should thank ourselves lucky the 3DS has had exploits for up to firmware 4.5 and then 9.2. In addition you have non kernel homebrew for the majority of firmware out there today, what more do you really want?

The thing is with the 3DS scene is the sheer amount of double standards and entitlement. Take Gateway for example, they get a lot of hate on this forum despite exploiting the 3DS on firmwares up to 4.5, then later up to 9.2, the work Gateway did probably lead on to a lot of the free custom firmware released by others which are out there.

Even when kernel exploits are released people still update, then complain at a later date. Look at how many people updated to 9.3 and beyond shortly after stuff was released for 9.2 knowing kernel exploits don't grow on trees.

Anyone who really wanted a kernel exploitable 3DS could still sell their existing 3DS and buy an exploitable one today with a bit of effort. Heck you could still buy 3DS's here in the UK on 4.5 long after the 9.2 exploits had been released.

3ds is a much cherished handheld and it's so popular. Having got a lot of attention, people have managed to exploit it rather early. And with the fast pace 3ds hacking scene has been going, people have high expectations.

On-topic: the solution for this for kernel users seems to be updating the eShop and nver... I wonder what would happen if we extracted the romfs and code from the updated eShop and inject it via HANS.

Would've been done by now. It's likely something's preventing it from working or that wasn't enough to circumvent the block.
