For this reason it's unwise to have an account tied to anything you're installing .cia on, since it's such an obvious thing for Nintendo to check.
Sounds just as bad if not worse to me. They'll see you're playing a CIA with NO NNID? Totes gonna see something's up.

Just picked up a sealed copy of resident evil revelations to use for headers. Any downsides to patching all my ROMs besides issues with save data?
Not ATM. Certainly the best course of action at this point.

For now it is safe, but probably not for long. I can only imagine Nintendo will eventually cross check CIA with your eshop account.

Unless they figure it out, a private and unique header will probably remain safe.

so what should i choose now? A cia rom or a 3dz rom (header from my own PKM OR)

Probably should do 3dz rom with a private header. Which bugs me because I think CIAs are much more convenient. I'm probably going to just use CIAs for offline games and 3dz for online ones. Actually I may even use CIAs for online ones but convert the saves to 3dz versions before going online.

can i for example... take a header from a game wich i have like retail fantasy life... and inject into a 3dz rom of pkm sapphire?

gonna count as a private header?

i mean CTR-P-BALE is kirby triple deluxe... wich i have the retail cart, but is a public header... so if i use MY personal header, dumped from my own game, BUT its the same of public header im in risk to got banned?
CTR-P-BALE is not the header, thats just the product code of the game, so a header ripped from your own copy of kirby would be different from the one that has been publicly shared

Damn that sucks :(

At least with mario kart 7 the save isn't that big of a deal (skill is more important)

I think i'm gonna start using CIA for everything, so that i can use savedatafiler. Plus it seems to be safer for not getting banned?

there is a solution with savedatafiler to get the raw save and inject it to the new header game

Tis a risk they're willing to take.

That's pretty stupid of Nintendo.... Many ppl buy used 3ds games... What if someone legally buys a used 3ds game from someone who dumped the game and is using that header? The two ppl don't even have to meet, it could be done through a trade-in like gamestops. I seriously hope that someone who bought games legally gets banned, just so that Nintendo can go fuck them selves when it gets in the news

its that technically is not stealing, but it feels like it for them, its their work, their data and we take advantage of it

If piracy wasn't an option would I buy every game that I pirate? No. Would I buy any of them? Yeah. And so would most people. So if we pirate a game that we would have otherwise bought it's about as close to stealing as you can get without physically taking anything. Just like when people steal from Microsoft by torrenting word or from HBO by torrenting GoT.

This all being said, I would totally pirate a car if I could. People can justify piracy all they want. I'm a pirate and my justification is that I think it's funny to talk about how that makes me a leech on society xD. So no I'm not mad at Nintendo for banning people. I just wanna try to avoid being banned myself.

There are maaany banned Xbox 360s out there. But that never hit the news. The amount of people who will buy a banned 3DS are few and far between but yes it does suck. BUT that just encourages people to buy them new instead. Why buy used and take the risk? If anything Nintendo's gonna profit.

either option is not safe, if Nintendo is really checking headers now, they can easily check if that header belongs to the game you are playing. If you use cias, they can easily check if you bought that game in the eshop. I guess the best question to ask now is... "Do you feel lucky?"

The people who have actual cards need to verify why they were banned and go from there, if Nintendo needs actual proof of the card than thats not hard to get, proof of purchase is all thats needed. If they have to send in there console it shouldn't be a problem with sky3ds users, nothing was modified on the console itself. For GW users, well.....GL....either update on 9.2 to reduce the risk of being caught ( and be running emunand on a 2nd SD card) or stay on 4.5 and be questioned.

That's a fallacy. I wouldn't have bought a 3DS at all if piracy wasn't possible. I'm certainly not the only one who was thinking like this, either.

Also a fallacy for the same reason as above. If those things were not available for free, people wouldn't suddenly have money available to buy them. Piracy, by its very definition, cannot be stealing. Nor is it "as close to stealing as you can get." Copying is not theft. If I had a device which could copy the physical structure and internal details of any item I pointed it at, I'd use it all the time and walk out of any retail store with my head held high. Corporations would hate me, but it would not be illegal, and it certainly would not be theft, as that would imply a loss of original property.

So any news regarding the ban? Are Gateway or Sky3DS any closer to give an answer to why or how this is happening, what the solution is to avoid a ban and what Nintendo says about it (there was a Japanese statement in another thread, but my Japanese comprehension is non existant)?
