EA Sues EA Over Logo

First post here in a couple months. I've been away very long because of the NBA Lockout.

Idiots use a different colour then Electronic Arts won't sue.

I feel like no one in this thread knows what the point of a trademark is. There would be no point in paying for a trademark if everyone else could use it. Trademarks exist so that no one else can pretend to be the source of a product, and sully the original manufacturer's name. That's why I can't make products with the apple logo, and sell them. Consumers might complain, and it makes a company look bad that had nothing to do with the product. They protect brand recognition, which is super important.

The main way to have a case in trademark law is to prove possible confusion about the source of a trademarked product. Two companies can even have the exact same name trademarked, as long as they work with different products with different logos. For instance, Gerber the baby product company, and Gerber the company that makes printers. No reasonable consumer would confuse the two.

But EA, and EA? Who both work with sports products? With Similar logos?

Electronic Arts totally has a case.

Not to mention: if you have a trademark, you are obligated to defend it legally or you lose it. It's not like copyright law, where you can pick and choose who you sue. If the company is aware of what they believe is trademark infringement, and they can do something about it they MUST.
