Um, actually I have a question, does when I used R4 for nds on my 3DS will it be a hacked 3ds? Though I wanted to play nds games without hacking it and used R4 for nds game, thanks.

Regular R4s won't work on it because they are blocked. You would either need to hack the 3DS and whitelist the cart or get a 3DS-compatible cart.

I was wondering about the Download Play application, it says you can download other people games, including NDS games or 3ds games. Does it work for pirated/roms game? Thanks.

Download play works on R4 and apparently Gateway but you are limited in the number of titles that support it and features on most of them (I.e. only can play as Shy Guy in a default kart in MK7).
