Hacking Question Does using the DevMenu really ban you instantly?

If you ever connect to the internet after doing anything illegal with this console, prepare to be banned.

If you never connect to the internet with the console, how would nintendo know what you have done?

I've used other peoples backup and updated them in OFW and I'm still not banned. But I think thats the equivalent of using someone else physical game card in your system, it will update as long as the update is free.
 
No, it is not an instant ban I've been using devmenu off and on for a little over a week (installed a few NSPs, gave myself a "debug" name and a custom avatar for a few hours) I have yet to get banned
 
Doubt that. At least the part with playing online using pirated(not dumped) games. That gold old time, when people who bought an overpriced sky3ds/Gateway got banned, and others using FreeShop not

i never got banned when using gateway + freeshop and everything you can think of on the 3ds.

but what got me banned was save editing the damned rabbit ufo catcher game. fuck Nintendo for even making that game.
they basically sold you parts of the UI.
 
Can I ask if you have funds on your eshop account? I haven't been banned yet and I suspect having a couple of bucks on my account might be the reason.

this is an interesting idea. id assume nintendo cannot realize or recapture those monies if they ban you

@Draxzelex could you add this to your Nintendo Switch Ban Form? Do you know reports of people who had funds on their eshop account or had previously bought something and got banned? If the reports of unbanned people have funds on their eshop account we might start to see a pattern.
 
On the Ban Hub spreadsheet I noticed a good amount of people that reported using DevMenu and are not banned. Is it really an instant ban or does it only ban after installing an .NSP and connecting to the internet?
I have merely used devmenu for changing my avatar to ratchet and Clank (and was online and have been playing online ever since) no ban yet.

lol, I also used to buy a lot of eshop games, still got a decent amount of balance left. My switch has used sx os, LFS, devmenu and homebrew. Positive wallet balance can be the key to anti-ban lol.

I don't think there are instant bans, it seems to be done manually and infrequently.

This would be me, the only reason I want to avoid a ban if I can is for when Animal Crossing eventually comes out. It'd suck if i couldnt visit my bros town

Technically they've already got our money if we've got a positive balance so they could still ban us, we've gone outside the lines of their specified EULA. But I'd be really surprised if this was indeed the key to anti-ban.
