Do I have created a disaster ? AKA noob

Well I don't know if I created a disaster but here is what happened, I completely forgot the interest of an emunand and I stupidly followed a tutorial which installs atmosphere 1.1.1 with FW 13.

On my 1st Switch (my daughter's) which was in OFW 12.x / SX OS Emunand 11, on which she plays online, using a new SD, I installed Atmosphere and upgraded to 13, then I have launched JKSV (and tried to launch Checkpoint which does not work) to backup a save, I also dumped the cartridge in XCI and NSP which I installed once immediately dumped. I thought I had a backup of the sysnand but actually no.

On my own Switch which was in OFW 4.1.0 / SX OS Emunand 11, I made a sysnand backup with Hekate then same bullshit as above, with a new SD, I installed Atmosphere and especially therefore upgraded my Sysnand in 13 therefore farewell 4.1.0. The dumped XCI (the game contains the FW 12) works on my Switch and I don't understand why (Emunand in 11 and the game embeds the 12)

So I have a few questions please if you don't mind

1: will my daughter's console get banned? I just went online, I updated this famous game, I was able to go to the online shop, so far everything is fine, I know that the ban can / could happen at any time

2: can I restore my sysnand aso downgrae to FW 4.1.0 from 13 ?

3: I cannot transfer the save of the game contained in the sysnand of the 1st Switch to an Emunand (checkpoint crashes / does not work and JKSV I do not know if it can restore elsewhere)

4: subsidiary question: why the XCI works?

That can happen any time.
Nobody knows.
In some cases you get in instant ban, sometimes it takes weeks.
And sometimes it never happens.
Only visiting the eShop might not be reason enough to get a ban.
Updating/downloading something from the eShop does usually get you a ban.

Depends whether your fuses are preserved or not.
Also whether you enabled your cartreader.
If you enabled that, then there is no way back.

Afaik, the emunand is a partition on your SD card and that is why you can't access the save files on the normal partition on the SD card anymore. You somehow need to move those save files over to the emunand partition.
Maybe Checkpoint has some feature for that.

4: subsidiary question: why the XCI works?

There is no such a thing as a game embedding FW12 and thus running on a system with FW11.
What some pirates do is just downgrade the minimum required FW because the game doesn't actually need the higher firmware. It's just a Nintendo release policy to keep everyone upgrading for general system stability improvements to enhance the user's experience. And plug some security holes in their system.

1. If you or her went online after using homebrew/CFW, a ban is possible. There is no guarantee that she will get banned
2. While you can, there is no reason to downgrade
3. You will have to launch JKSV in both sysMMC and emuMMC in order to transfer the save file
4. Atmosphere supports .XCI files; they just have to be installed
