Is it possible to transfer data (saves) from new 3ds to new 3ds xl (both have cfw)
If yes how? Is it risky?

If you mean specifically saves, you can back them up with JKSM a save manager and then re-import them after if you must

If you're looking to do a system transfer, you'll be fine and everything will still be there. If you only want game saves, follow the above method.

I just want to keep my animal crossing new leaf save, a friend of mine told me that save tranfer can get you banned so i wanted to know if that was true :/

That's not true at all. I've transferred ACNL saves between cartridges/downloaded copies a few dozen times using JKSM.
