Homebrew Can Nintendo ban me on my hacked 3DS for going online and trading FCs?

as far as i know, nintendo only bans people for cheating.
i doubt they're going to go out of their way to look for people's FC's that have hacked 3DS systems, they have other things to be worrying about.
