In the early days of the switch homebrew scene, using layeredfs, back ups of games were able to be played without the actual key (pre sxos as well). Could this hypothetically work with the preload version of Mario party?

no. The titlekey is needed to decrypt the content.
The switch won't be able to read the gamefiles if the switch can't decrypt the game content, which can only be done with titlekey.

Question answered.

One would think the titlekey becomes irrelevant in that hypothetical situation. The donor game has a titlekey and the host game is just being swapped via layeredfs. So the switch boots the original game (or so it think it does) but the files are swapped with the new game (Mario party for instance).

you don't understand, right?
you can't even use Mario Party with LayeredFS if you can't even extract its game files.
You need to extract the Game files first (romfs and exefs) which won't work without titlekey.

If you just extract the romfs.bin and exefs.bin from the titlekey encrypted game and want to use it with lfs, it won't just work.
Otherwise we could play all unreleased Games already when they're on the server.

Using the "Donor titlekey" won't work. Why? Because every games Titlekey is unique and used to decrypt the game content.
The romfs is encrypted with a very specific titlekey (which you don't have, otherwise you won't ask this question).
trying to decrypt it with another titlekey won't work.

You need the title key to extract the NSP to get the files for LayeredFS
