yeah and the guy who got the ban bought the console off someone who owned a SKY3DS so we can assume there was a ban reason

Haha, are you mad or something?if you don't want to get banned then don't use public headers. Not fucking hard. Use cia, and if you can't because you updated 10.4 then too fucking bad. We gave you two weeks of warnings and tutorials on how downgrade. And if nintendo catches you using a public header it's not just an NNID ban it's a console ban.

Gateway.[emoji14]Haha, are you mad or something?
And how would I able to use CIAs if I updated to 10.4/5? Think before you post at least, sheesh.
And I think you mean not just a console ban but an NNID ban. Could care less if the console got banned, that's why I specifically asked if the NNID got banned.

With my luck I'd get an irregular save data ban.I am to. But it's fun to mess with projectile spammers

Ahh, I'm too cheap.
I'm gud enough to not need them, of course. Right? I think I am.

My 3DS is at 9.2 and I'm using Cakes on 10.5, genius... Gateway isn't free, ergo, regretting that I don't have money for cheats. That's why I said, too bad and sucks for you. You had a 2 weeks to get CFW but you chose not to and decided to update your 3ds.

You like to assume stuff. Just stop.

The point of the thread was clarification. I cited a post that states that someone got banned with CIAs, but because of the thread, I found out that it wasn't the case.If you had all that setup, then what's point of this thread you made? If you're using cia, then you're not going to get ban.

I have 7 3DSes, but one ID. I really don't want the ID to get banned as I could just transfer the games to a new console. If the console got banned I'd just use another.

Not true, there is a rather easy way to tell, they can simply compare your launched non-cartridge titles with your eShop purchases. If CIAs don't use headers they can easily tell who is using digital versions of games and who is using cartridges and compare that with their eShop purchases. It's because cias don't use headers. So there's no way for Nintendo to tell if you're using a legit eshop purchased game or not. The only way they can catch you is if your CFW doesn't support region free patching to use out of region games online.
Even so, "legal" backups still violate the DMCA (because they circumvent copy protection) and definitely violate Nintendo's ToS. So in countries where the DMCA is in effect, they are still illegal, but regardless of that, Nintendo can ban people if they decide to, just because it's violating their ToS.Although, CIA files don't mean piracy all the time. These can be legal back up of owned games. Nintendo has no way of seeing if the person owns the cart or not. So, given that the owner used a legally owned game, they cannot do what Xbox does and issue any console bans. Maybe matchmaking, but not on the console. It's totally legal to use CIA files if they are legit and legal
Sure you can stay offline forever, but doesn't that ruin the point of not being banned from online? They can still decide to ban you the moment you go online if they want so it makes no difference if you stay offline or not.My eyes see that the law is flawed. Be that as it may, Nintendo isn't going to ban me. I black listed all servers besides GBAtemp, Google's servers, Microsoft's servers, Treyarch's matchmaking servers. If they some how bypass that, they must've manipulated my network traffic, or made yet another server. I will only buy yet another system, mod it, and keep it offline.
What about "Legit Cia"? Are those detectable?
