Wait. So if Nintendo puts a ban on my Switch, I won't even be able to access the eshop?

Yep eshop (means they don't want your money anymore) and games are gone. even though you payed for the games and own them. Bet if we made a big deal on twitter about it they will change that though as that seems how people seem to get stuff done now a days.

Normally that is not a reason to ban your console. Byy law you're not violating anything since it has been purchased through a website. Nintendo Always thinks they're above the law, this is what happens when companies get 2 much money that they start to bully and tell you they don't have to listen to the law. And for the people saying that he's violating Nintendo's EULA doesn't mean jack shit. Not everything in a EULA is according to law. In that regard when i sell a product i can randomly put in a contract that the buyer has to not wear clothes for the rest of their lives and they have to do it because they signed the contract. No that's not how it works and Nintendo Always puts themselves above the law regarding their EULA

Why the actual fuck don't they just provide you with a download code?

i guess the idea is they buy a game once, then sell the account to multiple users, the account gets banned for everyone and they're just like 'i guess you cheated online contact nintendo'
or something of that sort.

and i don't believe cfw will help you anytime soon either.

if you're lucky, you might be able to sell it online to someone who has no interest in online connectivity, or for parts. at half to 70% of retail price or something, someone will probably take it, but make it very clear and bold that the thing is banned forever.

no idea how much you could be able to make back if you sold the screen, battery, fan, case and possibly the motherboard with the charge connector seperately.
dock, joycon and cables are sure to be bought by someone for less than retail too.

But you CAN ban people from using YOUR shop as a result of THEM violating YOUR rules. It's like getting banned from an actual store for unruly behaviour.

Nintendo doens't remotely brick your Switch to make it useless (which would be against the law) - it still functions, but you are just banned fromn using their online service. I don't know about US law spcifically, but I cannot imagine something like this would be illegal over there.

And where in the law does it state that they can ban your entire console if you haven't changed anything code wise ? According to the law he did not do anything that makes the shop vulnerable, other users, the network and so on. There is not a single line in the law that says what he did is illegal. It only does in Nintendo's terms of service wich would result like steam does deleting the game but that doesn't give them the right to ban the console. Steam knows that and acts according to law and deletes the game from your library giving you a message '' we believe this key was stolen and because of that we deleted the game from your library''. Nintendo has no right to ban your console according to the law for something like this

if you buy a game digitally, you never own the game. you own a license and a license can be revoked if you break the rules you agreed to when you made your account and bought something from their online service.
and its entirely in their right to stop conducting any business with you to the best of their ability (which ends exactly when you buy a new console)
 
you should ONLY purchase download code from taobao. NOT account that comes with games....... dont fall for that BS.
A LOT Chinese switch owners got their switches banned due to the usage of this sort of cheap game account.
these games are either purchased with actual stolen credit card or the seller filed a stolen card purchasing request after you buy the account. either way, your switch with that account signed in is doomed

no, he (unknowingly) broke a rule where account sharing for game sharing is not allowed. really, these guys broke the rule for him, but there's not much he can do now. other than giving note of this specific service to nintendo in hopes some of their legal team can take it down to prevent others from the same fate

Like i said according to the law they have the right to delete the account but not ban the console. Why can steam follow the law plagued by more illegal stuff and Nintendo can't ?

If its too good to be true, it probably is.... Never use sketchy methods like this to get games. Cheaping out on nintendo gets you there..

The law is completely irrelevant in this. He violated their EULA. As long as having a statement in your EULA that forbids using bought accounts is illegal (which it isn't), their EULA is valid and allows them to punish you by banning your console if the law permit this (it most likely does).

It does. If their EULA does not violate the law (it doesn't) and their punishment does not violate the law (it doesn't), then they are allowed to apply said punishment for violating their EULA (which they did).

Again, I'm not overly familiar with US law. Can you state a law our court case that specifically states that a service provider can not ban a device from receiving service as a result of the user violating the terms of service?

Anyway, purchase the actual download code or JP/US nintendo eshop cards on taobao is fine. but since it's legit, the price wont be the same as those crappy cheap account.
 
I had a Splatoon 2 from psngames.org for a whole year
And never got a problem
