Just got a SpotPass notification detailing automatic updates.
You need to go to Internet Settings and enable it.

So there you go, automatic for those of us who don't plan on pirating our 3DS games.

Accoring to the thing, It just applies to game updates and the like (Like new pokemon in the Pokemon 3D viewer), it's not related to firmware, thus has no impact on piracy at all.
