I believe 2 people in this thread who received them (from 2 different retailers) couldn't get them working on a DSi while 2 people in another thread did (one of whom i'm not sure I trust) the other person had 5 carts and said they are worked with the DSi 1.4.
There's no way to tell if it will work on the DSi XL until you can either try it on one or try it on a DSi.
If you are going to send it back, most retailers act most favourably if you send it back within 7 days. If you send it back after 3 weeks they could turn and say if you knew it was a fake, why didn't you send it back earlier?
The odds are as long it's one of the clones which runs on a 1.4 you will be fine. It's possible AKAIO 1.6/ updated official software will block them as they always claim it doesnt run on clones, but I doubt it. They won't work with the DSi 1.5 FW if it contains additional measures to block flashcarts, but there's no guarentee a workaround will be found for the genuine carts either and you can always avoid updating to 1.5 if you can live without DSiWare / Browser etc. It's possible they may finally jailbreak the DSi to use all of it's functions with flashcarts and release a FW update to enable this on existing genuine AK2i's, but knows how long that will take, years maybe if ever.
Personally I would email the company with photo's of your cart and also refer them to the Acekard site where they claim these carts to be fake. Because it says it's AK2 and not AK2i in the lanuch window, you've got to assume it's not going to work on the DSi.
See what their response is, if they offer to exchange the cart for a genuine one you may as well take them up of their offer. It's possible they didn't intentionally sell you a fake card, but got duped by their supplier. If they don't exchange or refund and you find it doesn't work with the DSi, remove the orange DSi sticker from the box and flog it to a friend as an AK2.1.
