Basically while it can emulate a cart, it doesn't do it perfectly. neimod already did some tests with it and found that it responds incorrectly to certain commands, so all Nintendo has to do is check for these certain inaccurate commands and it's patcheroni'd. Anyone who says sky3DS cannot be patched is full of crap, DS carts are emulations of a DS cart but they got patched left and right. Gateway uses a system exploit to create an emuNAND and patch out various checks, so you can stay on a lower, vulnerable firmware and Gateway is able to keep doing their patches so their stuff continues to work on newer firmwares.

Thanks for clearing that up again, that does sound like a 1 line of code thing to get a certain request from the cart and it's puff Sky3ds; That is kinda scary O_O

Sky3ds is still my last resort but yeh, I don't want Sky to go, if it does Nintendo will focus all their efforts on Gateway

Nintendo is pretty unlikely to code in anything that kills Sky3DS or Gateway any time soon, if ever. If they dedicated resources toward it, it could surely be done, but Ninty has never been punctual about this type of thing. In my opinion, they probably don't care that much as long as consoles keep selling.

The good thing is that the 3DS is selling very well too,

but the only issue is this was the case with the DS too and THAT had some carts blocked unfortunately

well... a lot of DS flashcarts were clones or cheap brands back then. The good ones usually were able to endure or get ways to overcome their cards getting blocked.
But it's always a possibility unfortunately

So, what does this update actually patch or fix (on the old 3DS) if not the VC injection and Pokemon Injection?

on the other hand, Gateway got bested by Nintendo as they will not be able to support 9.5 on the new 3DS but some people in North America will want to perform a System Transfer from their old 3DS (including me) before Nintendo patches the VC and Pokemon Injection on the old 3DS in 9.6. once this happens, even if Gateway fixes 9.5 support, I would lose the injection stuff to do the transfer so it would end up with me playing my old 3DS XL more often then the new one.

Unless you need it for eshop access I would hold off for now until the online thing is sorted out. If you decide to do it make sure you backup 9.4 so you can go back.

I don't have anything to back it up with. Is anyone working on a Spider3DS Exploit for that? That would be a nice tool, seeing people would want to go up for eShop access and back down.
