Hacking 1st gen switch is unpatched. Does it matter what fw I'm on?

The exploit goes through RCM mode which is not affected by firmware updates. The only thing is when there's a new firmware update CFW might not support it for a while, but you can still create an emuNAND and downgrade it with ChoiDujour.
