can anybody confirm if there is a switch update on the actual cartridge or not , or will I have to update by other means my switch is banned and been stuck on 5.1 for a long while now

Even banned switches are getting the system update via internet. Have you recently tried updating?

Theres a 1.1.0 update nsp patched to work with 5.1. Google it if you want to find it.
