Would a fair comparison be as followed?
When I drive a car and a sign says i can only turn left. While I know its illegal to turn right I still do it. On the right road someone evil dug a large hole and covered it with something so drivers would fall into that hole. This breaks the car.
In this case the driver is fault and might get a fine for turning right, but the person digging the hole is guilty of a much more serious matter as he deliberately caused damage on other peoples property, even tho there shouldnt be a car driving that road.
In this sense it would almost be accurate heres why:
In this example the no right turn sign is the nand backup.
The issue is that the nand backup is NOT mandatory, it is optional thus not matching up with the no right turn sign(completely mandatory)
Also, I would like to point out that if you go into the choidojourNX thread there are users who cannot recover who also DID follow that no right turn sign and turned left instead(made a nand backup) if there are giant holes on both sides of the street created to harm cars and potentially the drivers within them, it does not matter which direction you turned because you can fall into the hole either way.
Right turn or left turn, following the warnings and precautions or not, there are still harmful results to anyone who chose to drive on that road.
Moral of the story: You cant blame a person for getting into their car and driving, but you can blame an asshole who throws rocks through their windows and kills the driver or places a potentially dangerous obstacle in someones path.
Let me ask this one last question:
If someones shoes are untied and you see them standing on one of the shoestrings, are you justified to push the person and force them to trip up and say "well you should have had your shoes tied"?
My answer is:
No because it is not the persons fault they fell. They didnt fall on their own accord, you thrusted them and forced them to trip over the shoestring that was untied.

A joke would be to tie their shoestrings together and then tell them about it before they fell, thus teaching them to the lesson to pay more attention to making sure they tied their shoes.
Long story short, they could have made code that just crashes the game or exits it and displays an error that says: "Hey we wanted to make sure you knew to make a nand backup if you already didnt have one. We hope this spread awareness."
Not make code that will punish anyone who didnt follow a specific instruction or happen to keep backup files stored somewhere on their pc or harddrives. Not everyone has access to that, you all are forgetting that some people hack their consoles with their phones and never use a pc to do so. Some also transfer files by plugging it into their sd card slot on their phone and copy pasting. Not everyone who uses phones to hack their console is gonna wanna dedicate 30gb of data to a backup of something they may never need when most phones only come with 32gb internal storage or 64gb.
