A possible breach of privacy is to examine and save the contents of your SD card, for example in order to determine you have non-genuine software on there they would need to look in your personal files. However all they need is one piece of evidence and they can easily get that legally, so i don't think anyone can get around a ban from a legal standpoint.I agree, but what law is it breaking and in what country? Well Nintendo won this round for sure, but the demand and motivation to work on emunand will become bigger. TX may want to put that on their priority list as it was on the bottom of their interest.

Are you sure you've done all the steps mentioned in this thread?I tried the eshop/browser method for re-downloading eshop games but it didn't show for me, just that I've already bought the game
Playing online/updating backups with their server is what triggering these bans. Emmunand can help reduce the chances by keeping our sysnand clean. Correct me if i'm wrong from what im seeing with the SX OSLot of people say emunand means nothing and can get you banned nonetheless
