I'm not sure you understand what they mean by personal information. They are not doing anything illegal by revoking your access to their service.
No i agree, Nintendo can ban you all they want. That's not the point i was making lol. All i said was ToS is not above the law.. Stop trying to win a discussion with me that doesn't even exist.

I have not been banned, and I've only been doing game mods. (Splatoon 2: Model mods, music mods, text mods)

I agree, but what law is it breaking and in what country? You mentioned the new(ish) EU law in regards to privacy,, but I'm not sure what breach of privacy you are referring to.
 
Called it just yesterday. I'm surprised it happened this fast though. I also think this is just the start, it will only get more strict from here on. Very smart of Nintendo to start the bans right at the peak of the TX OS release, it will discourage some people (very small percentage) from buying it.

For updates, I think Nintendo must allow updates for legal reasons in some countries. They won't bother blocking those for all.

A possible breach of privacy is to examine and save the contents of your SD card, for example in order to determine you have non-genuine software on there they would need to look in your personal files. However all they need is one piece of evidence and they can easily get that legally, so i don't think anyone can get around a ban from a legal standpoint.

Well Nintendo won this round for sure, but the demand and motivation to work on emunand will become bigger. TX may want to put that on their priority list as it was on the bottom of their interest.

As soon as I receive the jig I bought on ebay, I am getting that SX OS, who cares about online.

As soon as I receive the jig I bought on ebay, I am getting that SX OS, who cares about online.

I tried the eshop/browser method for re-downloading eshop games but it didn't show for me, just that I've already bought the game

Playing online/updating backups with their server is what triggering these bans. Emmunand can help reduce the chances by keeping our sysnand clean. Correct me if i'm wrong from what im seeing with the SX OS
once you load a backup its game cart icon stays on your game list.
 
only used own backups with cert, no piracy. never used clear logs in hekate, never used layeredFS.

  • Unchecked "Send Errors" in Menu: yes
  • SX OS Used offline: yes
  • SX OS used online: yes
  • Played with SX Backups online: yes
  • Layered FS Used offline: no
  • Layered FS Used online: no
  • Played with Layered FS Injects online: no
  • Connect internet with CFW homebrew : no
  • Connect to Eshop when CFW/Romfs mode : no
  • Played with Layered FS Injects with OwnCert. : no
  • Does the Eshop work: yes
  • Backups updated with what Firmware?: 5.1
 
Here is a short update:

After more than 24 hours after updating I was not banned (yet)!

-I activated SX OS offline and only used it in airplane mode.

-games with SX OS installed (offline)

-then delete the logs with Hekate

-OFW started and icons updated with the + button

-after that I started SX OS again in plane mode


I'll let you know when I get banned in the future but maybe that's the safest way to update for now.

Are you sure you've done all the steps mentioned in this thread?

Yep. I can do it via eXhop but not the normal way. If I go to say ROcket League (an eShop game I own), this is what I see:

Have you also tried it with a game you don't already own? And have you updated the download progress on your switch afterwards?
 
tbf if anyone knows tx they will make a way to get online they did with xbox with Ninja
