Aaaaand the ban hammer drops!

5.1.0 and never used CDN, using SX for the past couple of days (SX 1.1 since yesterday) with a shit ton of backups.. Updated all the backups when prompted (probably the reason behind the ban).. Eitherway I was expecting that to happen just not this soon.

Edit: I didn't do this new thing where u change the cart ID with a legit one to play online, so this isn't it.

Edit 2: Updating backups works just fine, while I can no longer access eShop.

Edit 4: Downloaded Rocket League (bought legitimately) and tried going online, got the same message. So, no.. You cannot play legitimate games online after the ban.


Edit 5: Games I purchased from eshop used to appear with a cloud icon in your games library (last icon on the right). Now they no longer do. I can only redownload games I archived instead of deleting.

Can you move you eshop account to another console? and keep your paid digital games?
 
sucks for nintendo that i had no plans to buy eshop/use their online service SMELL MAI FINGER NINTENDO nice try as for the cert bans well i hope gamefly is ready for an influx of spent switch cards lol lozers
 
Say after getting banned you buy another switch for online use only; if you sign-in to your Nintendo account on that new switch will it get banned too?

That would suck if the account is useless having Eshop purchased Online games..

If Nintendo bans your account as well, you might not be able to access and download your purchased games anymore, regardless on which console.
 
I haven't read it so i don't know. It's just that people tend to forget that even when you agree to the ToS it is irrelevant if it breaks a law.

He's right though. Just because a company says it's their "policy" doesn't make it right, or 100% legal. The warranty sticker debacle is a perfect example of this.

I got a second Switch tablet for $135 so I'm prepared in case I get banned. Not buying anything from the eshop on this switch as well.

Same here, got mine for about $200 new. And it was on 3.0.0 to boot!

I never mentioned Nintendo's ToS. By the way, many companies are having trouble with the GDPR in the EU right now, because it ís illegal to store personal information without good reason.
 
While a breach of the ToS can be challenged in a legal setting, unless you have a reason you were banned that doesn't involve hacking, I doubt you'll win the lawsuit.
 
By using their devices and services you confirm that you accept the terms of service. Nintendo reserves the right to ban or otherwise restrict your account if you violate these terms. By using homebrew or something similar, you are violating the rules and it is only justified that Nintendo responds accordingly.

I'm not sure you understand what they mean by personal information. They are not doing anything illegal by revoking your access to their service. Also to my knowledge, most ToS state that they can revoke your access for any, or no reason at all without warning.
