I’ve been using Luma CFW and FreeShop for a little while now, and I was wondering...
How illegal is FreeShop? (Not the actual program, with its intended use - however the use of title keys that you don’t own)
Is it just copyright infringement, or under piracy?
If caught, (I’m well aware it’s not very likely), i believe it’s only a fine for this kind of stuff. Not too sure though. Please tell me your thoughts!

It's illegal if you use it for piracy (which it's under if used in such a way)
freeShop itself is legal

Yes, it's illegal - at least for what 99.9% of people use it for. There's a reason Nintendo got it pulled from Github.
No, the odds of anything happening to you are really small, as long as you're discreet about it. See kongsnutz for more info on that.

Illegal but theres no way i can see you can get in trouble for it unless you show it to a cop as it downloads the game from nintendos servers and Nintendo can't tell if you brought a friends 3ds to your house to download their eshop games. You can also download games from the servers from chrome they will be encrypted but the encryption key is the same regardless of who buys it. so its more of nintendos fault for having bad security on the 3ds eshop servers. It could be argued its nintendos fault for allowing people to download games from there eshop servers for free since it uses a url download system so if you get the download url for a game you can download it in a browser.

yeah but its called free shop and its not hard to find the title key site so the freeshop name makes it look more like a piracy app then an open source eshop. an yet people aruge its not a piracy app when it clearly can be used for piracy so easily and the name makes it look like one.

there is a reason why piracy isn't enforced as strong as most people would be in jail if they did that since alot of people i know have pirate stuff.

It's illegal, yes, but it being punishable depends of where you live. At least in Finland (I think US is the same, but not sure) as long as you're just downloading for yourself there's nothing that can happen. Torrents are a different story because you're also sharing it with other people while downloading, but I don't think too many people have got into trouble for using them either.

its not stealing is copying because when you download some thing is a copy from the server if i copyed your game you still have the game if i steal it you don't.

You are stealing data from Nintendo and money from the developers, ergo stealing. It gets warm where you are all going. mauahah

freeShop itself, the homebrew app, is not illegal. The act of piracy itself is illegal no matter what app is used to install pirated games. Basically freeShop is as legal FBI, ciangel, and other apps, it's how someone uses that determines the legality of their actions.

yes but they don't get paid for the second sale like new games. Its like selling some one elses stuff.

Only the copyright owners have the legal right to make new copies, which they can then sell.

When you buy it you get the legal title to it, so you can sell it but you can't make another copy.

An unauthorised copy deprives the copyright owner of that sale, but buying it second hand doesn't as they've already been paid.

Publishers don't like that you can sell it second hand, but they don't have any legal protection. They do have legal protection against unauthorised copying.

well you can but the law can't really stop you from copying some thing and giving it to your firend no one one know except for your firend and you unless you tell them its illegal but its like its legal because nothing happens. Its why you don't really get in trouble for pirating because its to easy to do an every ones probably done it once. Its not easy to steal some thing in real life and get away with it. They target the uploaders as they are the ones who make it available for people to download theres no real point with the downloaders.
