That might work. I think game updates can be downloaded without updating, so it makes sense.
I would need to test but I believe it will run-a-foul when it sees the wrong version number on your FW. The eShop and the Nintendo Shop are just splash pages for what is the same service.
It will likely give an error that it cannot download without an update.
As speculated in my original post and than tested by iAqua, it just prompts an update.
