any change that the 3ds, secretly sending encrypted message to whenever it detects 'backup' / flashcart being used (probably in recent fw) to Nintendo? , and kept those records... until one day make action..., while they already have your email address, possibly credit card detail address, club.nintendo detail.. etc.

my point is,
there are many ways to void "got stolen" argument, as there are many ways to detect, even our location probably they knwo, the same ways google know our location even without gps, as long we wifi enabled... (map by wifi ssid, and correlate to other device which already have location info and detect that same ssid, no need to connect just within range)
of course this is just a speculation, wether out 3ds is doing that or not, but if yes.. then they have our data....
The amount of people pirating compared to the entire 3DS ownership is too trivial to amount to any sort of Nintendo surveillance. I'm also pretty sure what they'd be breaking a lot of laws.
It would be pretty scary though if they were collecting our personal data....
