Can I play online games/use Miiverse etc with no risk of being banned or anything? What about eshop?

Particularly Mario Kart 7?

Also will Smash 3DS likely have full functionality with SSBWiiU?

It has all that. Except for the 'risk of being banned'. Even legit owners can get banned by doing nothing at all, being banned is outside of your control.

if you have a 3ds(xl) on firmware 4.1 - 4.5, then you can use gateway and create a copy of your NAND and then update this so called emuNAND to latest firmware and then access all the 3DS online features such as eshop, youtube, miiverse and online play, for tha latter you will have to rename the .3ds rom files to .3dz and insert a card ID into the header, either from one of your own cards or from a community shared one
tutorials for that are inside this forum, use the search function for that
about Smash 3DS and Smash WiiU, noone knows, as the WiiU version is not released yet, it might work, it might not

if you use a community shared header oder use a header from another game (yes, you can do that), then they can probably see that, but may just don`t give a fuck unless you actually cheat
ninty`s banning policy so far has always been to ban cheaters and to don`t care for backup loading, but this is no guarantee for the future

There has been no report of anyone being banned as a result of using Gateway.

The only bans thus far have been cheaters & exploiters, and it's the legit users doing that.

I have a question about 'being banned'.
What gets banned? The cartridge header? The 3DS unique ID? Just from the game? All games, like, no online anymore?

What exactly am I no longer allowed to do? I can't play ALL games online? Or just the game I got banned? If I use a different header, can I go online again? Or?

If they do it like Sony it would be your system id and your account. Word is some people who had there ps3 banned bought ps4 and signed in with the account they got banned on there ps3 that Sony banned there ps4 after signing in. So if NIN goes that way you would have to get new system and account for now. Being able to change console id may be possible later on like the ps3 and Xbox.

Banning can be done on a console or NNID base. Either is possible, since Nintendo already uses consoles and NNIDs for checking unique 3DS units for eShop purposes. Banning a console usually means you have broken the terms of service (ToS), which can be seen as a legit way of banning someone. (Online is a service, not a part of the console hardware itself).

No, if you don't use the same NNID on the 3DS and WiiU it should be fine. Also yes that's what a console ban does.

Theoretically they could find your WiiU on the same network, but with dynamic IP addresses, you never know. As we've yet to see a Nintendo ban wave for flash carts, that's all anyone can say.

As for doing a console ban, Nintendo would be purely stupid if they let the banned console into any online service. This is also purely speculation, but I see no reason why something would work if your hardware was banned from Nintendo's network

They need to crack 6.x + save encryption and make saves region free :)

First, I fixed your post as it was 6.x that introduced the new saving encryption. They may have already cracked the former, but left it out because they currently don't have a way of changing the encryption of existing saves. Of course it's purely speculation at this point, but makes sense as a means of preventing customer backlash. Could you imagine the outcry if everyone running emuNAND had to restart all of their 6.x+ games because of an update?

As for making saves region-free, that would also require a tool to decrypt and re-encrypt saves. Even then, there's no guarantee that it would work with every game, as past gaming platform generations have had games with save files that only work on a specific region release. Region-free saving is always going to be on a case-by-case basis, regardless of platform. Unfortunately, until someone raids Datel's HQ to gain the tech behind the Powersaves, we're just going to have to wait until one of the scene devs/flashcart teams figures out how to make this encryption skeleton key. At that point, we'll finally be able to see a save-sharing community that isn't as highly restricted as it is now.
