If Sony didn't go under after the BIGGEST PERSONAL DATA LEAK IN THE HISTORY OF DATALEAKS, Nintendo can be sure they can do ANYTHING THEY BLOODY WANT, and get away with it. Yeah. You know why? Fans. The retards who cheer and whiteknight for them no matter what. They find the numbers AGAINST bricking they won't do it, but make no mistake if they find the numbers IN FAVOR OF the bricking, all hacked 3DS-es will be expensive paper-weight, end of the story.
You might not be aware but SCOTUS took away your right to class-action if the TOS you signed specifies mediation, and it's highly unlikely any individual will sue, considering most of these individuals aren't even of the legal age to do it (no, mom won't pay for court costs to sue Nintendo over your "toy"). Remember that Microsoft can and will effectively "brick" your 360 if found hacked. There's nothing you can do about it.

Caveat: I am aware there have been no bricks. Yet. Reason? The 3DS hasn't been hacked yet.

This is bullshit.
They can ALWAYS brick your system and claim it was due to what YOUR modifications did to the system that raised the system failure. It doesn't matter AT ALL what the law says here.

This process cannot be undone and will be demonstrated for you right now

I am amused as to how many people can say fuck pirates... IF YOU HAVE WATCHED MUSIC VIDEOS ON YOU-TUBE, YOU ARE NO BETTER THAN THE PIRATES YOU ARE ALL RAGING ABOUT. either you are against piracy in whole or shut the fuck up. also a bricking will only occur if the update gets corrupted while installing due to modified system firmware(like Home-brew channel) not flashcard use. why is it that people who have never actually soft-modded anything think they know whats going down, sounds to me like you are mad at yourself for never trying Freeware home-brew or any modding, i am done with fear mongering, i have an AK2i icon in the first day of my log files and i will not hesitate to update when it comes out, they will not brick my system because i did not do anything that would result in a brick. remember if you use your VCR to record a tv show or watch a music video on you-tube you are stealing and deserve everything you shell out against falshcart/homebrew/softmodders. THAT'S IT,THE END, STOP CONTINUING LIES, ITS NO BETTER TO SPREAD FEAR THAN IT IS TO STEAL SOMETHING.

If there's lots of brickings somebody will look into it, and if they find that the bricking is done on purpose Nintendo's going to be in trouble. There's companies out there that will do a professional disassembly of the device if it could mean getting attention for being the company to prove a scandal like that.

As I said, SCOTUS has passed a resolution that if there's a mediation clause in your contract (Which now there is in each and every one of them, you can bet), you can NOT start a class action, only mediation. (And mediators are basically paid by the corporations, so good luck with that). Realistically, you can't class-action in the US any more either.
That doesn't stop someone with lots of money to just stick it to Nintendo and sue individually, but how hard is it for a corporation with the resources of NOA to out-lawyer basically any single person?

Scalia said companies like arbitration because it is efficient and less costly. "Arbitration is poorly suited to the higher stakes of class litigation," he said.

But the dissenters said a practical ban on class action would be unfair to cheated consumers. Justice Stephen G. Breyer said the California courts had insisted on permitting class-action claims, despite arbitration clauses that forbade them. Otherwise, he said, it would allow a company to "insulate" itself "from liability for its own frauds by deliberately cheating large numbers of consumers out of individually small sums of money."

Breyer added that a ban on class actions would prevent lawyers from representing clients for small claims. "What rational lawyer would have signed on to represent the Concepcions in litigation for the possibility of fees stemming from a $30.22 claim?" he wrote. The court itself divided along partisan lines. All five Republican appointes formed the majority, and four Democratic appointees dissented.

Still pending before the court is a major dispute over class-action suits involving job discrimination. Lawyers for Wal-Mart have asked the justices to throw out a sex-discrimination claim brought on behalf of 1.5 million current and past female employees."
