I think the video is a fake.
No "Nintendo 3ds" or "Health Warning" splash screens... even though the person clearly powers the system on. The system just boots to the menu? Doubt it. Do you have to press the power button to get out of sleep mode? Doubt it.
I do not have a 3ds yet, but even the DS Fat had a health warning screen... and with reports of eye strain and potential damage have already been addressed by Nintendo, the omission of a "Health/Safety" splash screen on the 3DS seems totally unlikely.
Also there are no LED's lit up on the system that i can tell.
I say fake. If i'm wrong who really cares.
[BTW: I'm not sure if Splash Screen is the proper terminology - I mean to say the screen that appears as soon as you power the system on - Like the DS and Wii screens that read "Read your owners manual before playing" or something like that]
