I'm fairly certain this is the reason, but I would love to be proven wrong. Nintendo collects a ton of telemetry and probably has a way of detecting which cartridge is being played when. If the cloned one and the official one (or two cloned copies) is being played at the same time, you get hammered with a console ban. Simple as.
This is why MIG killed the second-hand market. You'll never know if your cartridge is being used by someone across the world. Thankfully, the people who use MIG are fairly rare in my country. But again, you never know.

I'm NOT saying they have such a system, but I'm pretty sure telemetry logs + retrospective analysis (even as going as far to use AI bots to check timestamps overlap) could work it if a ban is needed.

I put the mig switch on my switch 2 and didn’t get banned. I didn’t launch the game, just inserted the mig switch and deleted the game from the homescreen afterwards.
I read a bit about the "Match Version with Local Users" topic here in the thread, in order to update my L.A. Noire MIG dump on my Switch 2, since it requires a mandatory update to become a complete game.
I saw that @jasapolis and @dolpf seem to have the best success with a Switch 1 on 18.1.0, while using any other NSP installer than DBI.
What I can confirm is that DBI is not the installer of choice, since it threw an error for me, while trying to transfer the update to my Switch 2.
However my Switch 1 is on 20.0.1 (AMS 1.9.0) and my Switch 2 is on 21.0.1 and it worked with L.A. Noire update 1.2.
I did the following:
1) Install the L.A. Noire Update 1.2 with Goldleaf on my Switch 1 (20.0.1)
2) Install the L.A. Noire XCI with Awoo
3) Do the "Match Version with Local Users"
About 2): My Switch 1 has the 3.0.0 fuseset, so I can't/won't use the MIG on that system, since I would have to burn GC fuses, which I try to avoid - everything I did was on an 20.0.1 emuMMC.
What I wonder now, is if @jasapolis and @dolpf only had issues with Nintendo titles, if they tried to update them with a Switch 1, that was on a higher FW than 18.1.0
I see him/them having issues with Matroid, Mario and Zelda titles.
Did anyone figure out what might be special about 18.1.0? I saw on Twitter, that Nintendo (during the Switch 2 launch) blocked some Switch 1 game on certain FWs, if they didn't had one specific installed, while they worked perfectly fine on ealier FWs.
Could they've introduced checks some where between 18.x.x to 2x.x.x to avoid any issues on Switch 2?
