Yuzu emulator shutting down, paying Nintendo 2.4 million in lawsuit settlement

maxresdefault-391830162.jpg

Just last week, on Tuesday, February 26th, 2024, news broke out about the Yuzu emulator team being sued by none other than Nintendo themselves, with Nintendo claiming that the emulator apparently allowed users to play certain games early (due to street dates being broken) and also allowing piracy of the current Nintendo Switch system.

Today, in a rather surprisingly quick manner, it seems like Tropic Haze LLC., the company behind the Yuzu team, has reached a settlement with Nintendo in regards to the lawsuit. According to a recent official document uploaded just a few minutes ago, Tropic Haze will pay up 2.4 million USD in favour to Nintendo, with both parties agreeing in the settlement and its amount.

UPDATE: According to the proposed Final Judgement and Permanent Injunction document, Yuzu as a whole in its current form will cease to exist, meaning no further development and prohibition of any distribution of built or source code forms of it.

What is going to happen to the Google play store version? Will it be removed from devices where it is already installed?

No, it only got delisted from the playstore. APKs can still be installed and already-installed instances of Yuzu won't be affected.

Every time I read about those kinds of news, that's exactly my thought.
Japan's and USA's companies are quite prone to sue people wanting to exploit their belongings how they see fit.
Legal system in USA is messed up, allowing to sue without repercussions as the lawyers caste take care of everything. In Europe you can sue too but it is riskier because in case you lose you pay the other's fees

I read somewhere that Yuzu handed over everything to Nintendo. Including it's website, program code, etc. So I think Nintendo will now also have the dev's logs of user feedback? Like, "user ABC had a crash when runnning this ROM on device X etc"

Yuzu code available for Switch 2 for better compatibility and performance, what a steal !! Might as as well hire the developers too.

Now Switch 2 schedule can be pull forward. Everybody wins.

Where do you base that on?

Although it is very likely that the code from Yuzu would work with a Switch successor, given the similar architecture. That could’ve been the reason Nintendo wanted to take it down.

No, I am talking about Switch 2 now can run Switch game almost flawlessly thanks to this, not Yuzu 2 the Switch 2 emulator. The chance of a Yuzu 2 was very very slim.

Nintendo at one time or maybe still didn't confirm Switch compatibility for Switch 2.

Android can do Switch better than Switch 2 is as bad as Boeing with flying doors. Now Nintendo have time and a fixed target to ensure that that don't happen. No doubt that outdated yuzu would still be working fine on Android for many of the games that are already working fine on current version.

Whenever I read stuff like that, I wonder... If I would publicly offer anything that might offend a big company (emulators, ROM sites, fan games, whatever), I would make damn sure that I'd stay 100% anonymous. Never show your real name, don't host stuff on your own servers, hide your IP address and be careful who you trust. Why is Nintendo always able to sue everyone? I guess it gets tricky whenever real money gets involved (Patreon). Might be better to only accept crypto payments.

Look up the WIPO Copyright Treaty. Over 100 countries have agreed to enact this type of law.
Don't think I'm against every forms of copyrights, though. What is infuriating, IMO, is the way it is sometimes over-applied.
If your software, in the emulators' case, doesn't use any of the source code from the emulated device, you should be allowed to legally use the said emulators with copies/backups of your legally owned games.
I understand that piracy on a large scale could hurt some entities, but I don't think the vast majority of users would go that way, especially for the Switch (clearly a family-oriented platform, people understanding and willing to put the necessary time and efforts to be able to pirate their games is surely averaging 5% of the worldwide users at most).

If you're against piracy, just target the website sharing dumped games.
Or better: just sell them on your own marketplace or offer a solid and profitable alternative (Nintendo would surely make a crazy amount of money if they were offering their own "Yuzu" and added an official eShop to it... In the actual situation, nobody wins, as Nintendo likely won't make more money from Yuzu's users and people are deprived from a way to enhance their experience with Nintendo's games).

The guys are running the Switch on an Android SoC (for reminder, it's a custom version of a 2015 SoC), just imagine for a split second if they were offering an app on smartphones' marketplaces... Missed opportunity, and they wouldn't have to deal with hardware themselves (goodbye JoyCon drift). Just give a try to Dolphin on a Samsung S24U through the DeX app and using a compatible controller, and you'll understand the wasted potential.
For illustration:

In the end, it seems we always come back on the "Nintendon't" topic. 😅

Then again, nothing smells fishy like crypto.
The idea is that they were not doing anything illegal, so why hide? The other thing is that of course they got cold feet when they got sued. Well if you are not going to stand up for your work, then indeed better protect yourself with anonymity.
