I read a bit more about it and found out about Ckeckpoint. With that app I should be able to transfer the game saves from the one switch to the other but will these game saves be on emuNAND only or also on OFW and on sysNAND? I really want to have my Splatoon 2 gamesaves on an unbanned Switch on OFW for Splatoon 3.

because your save is a higher version than the game now.
ex: you cant have a 1.0v game with a 1.5v save.
update your FW. no reason not to.
a save is a save once backed up, can apply it to any profile on any nand on any switch (provided you can actually get it to said any switch)
go airplane mode, hack it, create a emunand, exosphere your emunand, then turn off airplane mode.
then only ever do hacked stuff inside that emunand. never go into syscfw. only ever OFW or emunand thats it. thats the only way to 100% protect yourself from a ban.

emuMMC and sysMMC operate independently of one another. They don't share anything software related; only the hardware they run on. You have to understand though that while Checkpoint can transfer the save file, that involves hacking both consoles which means you run the risk of getting your new console banned.

First, never ever follow YouTube videos. They are notoriously outdated and never made by any trusted members of the community. I recommend following a written guide such as this one. Secondly, you cannot use your console to play online if you use something like 90DNS or an alternative. But bear in mind that you risk getting your console banned if you bring it online after hacking it.
Just format the SD card to FAT32. You shouldn't be using exFAT as it can corrupt your SD card.
While there is file limit size of 4 GB for FAT32 and there are many Switch games that are bigger than that, there are numerous workarounds to that restriction. You can split the game file into <4 GB chunks or alternatively, use the more popular method of USB installation.
USB installation, as the name implies, installs game files via USB. By installing them that way, it goes around the file size limit of 4 GB with FAT32. As for the system update, while you can technically update your console, you don't need to. The reason the console wants to update the system is because the Switch doesn't come built in with exFAT support. This is an arbitrary restriction set by Windows. You just have to use a third-party tool to format the SD card instead. I recommend using GUIformat
That is basically what USB install means. You connect your computer via USB cable to the Switch and use a program on the computer as well as a homebrew app on the Switch to install games.
gotcha - very limited space? but at this stage im not really sure just how big the switch games actually are?!
i know on the wii u there were some very large games and fat32 would never have been suffiecient enough
