That might not be the best idea especially if the previous owner went online with the console causing a mismatch of logs.
Fyi, the set came with cfw sysnand 9.1.0 with partial backup (BOOT0/BOOT1 & eMMC SYS), unfortunately not idea is the backup a clean nand or tainted though. Currently it is 10.0.2 but the burnt fuse remains at 11 as I had offline upgraded it. So now what is the best bet? Restore with partial backup > Go eShop? or Haku > Restore with ofw 9.1.0 > Go eShop? Any idea? Thank you.

As I said previously, if the last owner went online with the console, then trying to restore the console to a clean slate will cause a mismatch of logs from Nintendo's servers. Unless you can guarantee 100% the previous owner never went online, its better to do neither of those things.

Hi i was banned few months ago. I am on 9.1 only with sysnand and Atmosphere 10. Now I have played ACNH for several hours and I im thinking what will happen when I want to update the game. I mean, if next update necessary needs for example 10.0. How can I update to 10.0 or more without loosing my savegames? Do I have to update with choixdujour? I dont have nintendo account of course so I dont know what to do because sooner or later this will be needed. Sorry for my english.

If you are banned then you won't have access to nintendo server but that depends. Some bans are limited to eshop but updates are still available. For minimal requirement version, i guess you can either google it online or download the update nsp then open it with some sort of viewer like XCI-Explorer and look at the masterkeyversion. To update a switch running cfw, use choinx. Just refer to any guide and you probably get more insight than what you are currently asking.

I would say do a full backup of your switch using hekate now as a backup backup in case the previous owner messed it up for you.
Make you get the keys as well, but i am pretty you will be banned as soon you go online. Can't hurt to try anyway
 
I've been recently banned, here are the information for science's sake.
As soon as emuMMC came out, I made a partition based emunand right away (in June I think). I didn't modify anything before that.
I've tried to keep sysNAND as clean as possible and the emuNAND as offline as possible over these months but obviously I screwed up somewhere.
I got banned between monday and thursday (25-28 of May); I don't know for certain since I kept the switch in emuNAND for various days.
Error code's 2124-4508, I suppose my account is fine.
As for CFW I used Kosmos with sigpatches for a bit and then switched to plain atmosphere (still with patches), also I've always booted with hekate. I don't have AutoRCM, I didn't clear any logs and I don't have incognito.
Back in August I put my switch in it's dock, and it was hooked up to ethernet. I was on cfw playing a legit cartridge game but with some .nsp updates installed. I realized after a couple of minutes, plenty enough to get banned although it's weird that they took this much time.
I'm pretty sure that during these days this week I didn't screw up (I have since set up 90DNS on the ethernet profile, as well as disabling autoconnect), however the timing suggests otherwise. Is it possible that nintendo has started scanning the sd card?

Since you were online at some moment with cfw and nsp installed , you were going to get banned it was just matter of time, the good thing is now you can have 2 switches one for cfw and another for online play

I already have an emunand for all my homebrews, but I'd like to play my games with better visuals and frame rate. I also want to keep my saves on my sysnand, that's why I don't want to play my games on emunand.

Yes you risk a ban for using any CFW/homebrew.
 
I'll assume the answer is yes already, but to double check: I pretty much set up my switch today with hekate, I got my backups of boot0/1 and my rawnand, as well as the keys because the guide I'm following pretty much told me to. Beyond that I have done nothing else. I have not launched Atmosphere.

If I restore the rawnand now and then turn the switch off, and boot into regular startup and play online (I removed my wifi settings before I booted into RCM for the first time) do I run the risk of getting banned? Like I said, I assume yes just because I've run hekate already. If it helps both games I want to play are legitimate digital copies.

Actually the answer is no because Hekate does not count as CFW nor homebrew since it is launched in RCM which itself is triggered before the eMMC.

Oh damn, was not expecting that, but that's good news. I wanted to check if my switch was unpatched and do the backups, but I'm not ready to dive into homebrew just yet.

In that case do I even need to restore my rawnand at all before I boot into regular mode in this case? Is it pretty much just the same since I haven't used any CFW/homebrew?

You don't need to restore it until you've run CFW/homebrew.

As long as you setup an Emunand and incognito for your CFW+homebrew you're about as safe as it's possible to be. Happy days
 
Just out of curiosity has anyone received a ban for installing game nsp’s in emunand under hidden partition using sxos of course? I haven’t myself I also update the nsp via Nintendo servers. I would like to know thanks.

Edit: has anyone not and installs game nsp’s and update all the time?

At the moment you connect to a Nintendo servers with cfw and nsp installed you will get banned sooner or later , yes there have been cases of banned persons for just connecting and updating their nsps in cfw

Thanks for the reply. I’ve been doing it for a while now with sxos emunand hidden partition I was wandering if anyone else has had the same luck as me and not been banned. I find this Nintendo banning very bizarre some get banned asap but others like me never do I wonder why that is?
