Should be alright as long you don't cheat in pokemon or play the game online before they are released you are good to go.
The fact that in Omega ruby I cheated once because i wanted Charmander in my party so i used a cheat to catch it on regular route is considered as cheat? Are they trying to detect <<hacked>> pokemons?

Usually they don't really care, as long you are not playing games before release date, and cheating during online play then they won't really ban you.

I've received obvious hackmons through Wonder Trade before (starters in illegal balls, impossible shinies, etc.), and nobody gets banned for that. You can even put those same mons on the GTS with zero consequences.

    Eventhough the New 3DS XL is more powerful, I still feel like the DS Lite was a more polished system. It's a real shame that it never got an XL variant keeping the GBA slot. You'd have to go on AliExpress and buy an ML shell to give a DS phat the unofficial "DS Lite" treatment, and that's the best we'll ever get I'm afraid.

    @Jayro, I don't see whats so special about the DS ML, its just a DS lite in a phat shell. At least the phat model had louder speakers, whereas the lite has a much better screen.
