Yeah, but he is using Homebrew Online. Ehen you playing SNES Emulator Online, I think its a big think for Nintendo for banning
True, but you also have to look at how many people have used homebrew, SX OS, or even LayeredFS online without a ban in sight. At this point, its leaning on the not-so definitive side. If its any consolation, I do include any related offences when compiling SX OS only bans under Statistics for the Lazy to acknowledge it may not have been due to SX OS alone.

Honestly I dont know the reason for me being banned.
I specifically stayed away from anything that would be logical for a ban, as in scene dumps, nsps, layered fs and so on.
I was in the section of people who believed privately dumped games would not be a real threat in the long run.
Sadly well I am no in the banned section as well.

I have started a conversation with Nintendo NL as to why and how,
Because with 100+ games (of which 50 tiles physically and the rest digitally) ... I am still literally a big supporter of Nintendo and well eshop acces would still be greatly appreciated :p

PS: I can access the eshop on PC and even purchase stuff (did a test with a small title to make sure)
But sadly it will not download to my Switch as it seems I have what is considered a system console ban.

Were there any crashes when you were using SX OS to run your backups? Since you didn't clear your error logs, that's about the only thing I can think of outside of Nintendo realizing you paid money for a CFW XD (Note: this is NOT an anti-TX joke)

If your account isn't banned, at least, you can always move everything very easily. Just sell your Switch for a slight loss and then buy a new one, and sell the dongle and more or less make up the difference. You'll probably lose like 10-20$ in the end.

But they may also unban you depending on how well you sell the story and given you are a big purchaser.

Nah I get what you are saying, I might have been one of the most less piracy driven SX OS / SX Pro users.
I did have some errors, but with that I mean the same type of error that also happened every now and again with homebrew. The sporadic random lockup / crash.
Besides that the only game giving me hard times was; FIFA18, which was a bad dump of WAIN and Yoku's Island Express which ended up being a software update issue (of the game itself)

This would imply that anyone who runs into those types of crashes should be banned for running homebrew only yet there is evidence against that. The only difference in your case is that you were running SX OS. Still strange, but very valuable intel nonetheless.

Yeah I hope the conversation can be that open with Nintendo.
The only real reason I was using SX OS / SX PRO; is I dont think it is fair to pay twice if I want a game physically and digitally.
I have payed for every game I own. Piracy in it's pure essence is not what I am after. I just want a system that respects the collector and the on the go person really.

But indeed as I can still access the eshop it is not a Nintendo ID ban, thus moving towards a new Switch could still happen.
BUT well let's be honest; this has pushed this setup into ... lets' try and see what we can do more now type of Switch.

If they disallowed me from online I would have been ok with it really ... the ban for the eshop well ... I thought I might have spent enough on their not to get that :p But let's see how things go.

Yeah if I was banned I hope they can be open about the why, if it is the stance on all backups are evil or homebrew is evil. Ok cool I can understand that.
But it just kind of sucks that it invokes an eshop ban, when I am actively buying both physically and digitally.

Still it makes me wonder how the system / console ban is determined. Is it tied into the system serial? a system cert? or? Maybe one of the more involved people can tell. Maybe even @SciresM can say anything about that.

I'd imagine they don't distinguish in SX detection. If its detected, they nuke it.

Yeah it might be as simpel as that. But we dont actually now at this point.

Given the handful also banned the moment they went online with SX, I'd think that's basically it. The details are muddled in all the cross-pollination between SX and LayeredFS but we have enough cases of just pure SX use to tell us that they can sniff it out too.

Every Nintendo Switch console is given a unique certificate right before they leave the factory. Think of like the certificate used for cartridges but way more specific. They blacklist that certificate from making requests to certain servers. But with CDN downloaders, you can use different servers to still make valid requests after being banned.

And yes V-Temp, I am aware that Nintendo may not leave it like this in the future, but the point is that its an oversight they could have seen coming beforehand and did not.

I wasn't going to say anything. :P
Consider it covering my tracks ;)

While I cant disprove it all I can do is give more insight; I have been going online ever since the day SX OS was available.
Not sure if that means anything really but well for the sake of keeping things clear let's note that.
Noted :)

Hmm intriguing really. But what I am wondering, lets think that scenario out loud.
I can still use the PC to access the eshop and purchase titles.
Which means my ID is still allowed to aquire games.
Is there some way or fashion I can actually get those games on my banned Switch then?

I really need to read up on that ... but if someone can give me a nutshell answer that would be awesome.

@PatrickD85 I know you said you didn't have time to upload proof, but everyone would greatly appreciate it to silence the potential doubters for your story. It doesn't have to be today or tomorrow, just whenever you got a chance.

Ok what do you want me to do; video me going to the eshop, starting a more online only game like Rocket League ... ehh anything else?
I'll hook up my Elgato later on and make some recordings of it.
