Potentially important, The switch could actually be writing the logs or some other thing into the SD card itself, so maybe that's what is causing the bans? I already wiped it to make sure. If you wanna go the extra step then maybe it's worth it?

BTW, I have truly no idea what nintendo writes on the sd, so this could or could not be the case, anyways, I would like to know if i'm wrong.

Nah I am just speculating, I really hope they don't, but in case they do, I've already formatted my SD, the time it takes beats the risk.

What I did see was that the dreport tool may just ban people according to SciresM, the tweet is the newest dated at 11:54 AM - 25 Jun 2018.

That's not what this thread is for.
Great, things just went from bad to worse. Now I have to ask users what firmware they've used it on and configure the spreadsheet to recongize Y 5.X as bad. Thanks for making my life harder, Nintendo. This also potentially invalidates literally everyone's responses up to this point because now its up in the air whether everyone ran it properly and on the right firmwares.
For SX OS Version, I'm referring to SX OS itself (i.e. 1.0, 1.1, 1.2) not the Switch's firmware.

Ok so I received my TX OS Pro today from the 3DS site. These are the steps I took.
1. I went ahead and fully initialized my console to clean out all possible information and have a freshly formatted system.
2. I updated the console to the latest system firmware 5.1
3. I created a throwaway email and linked it to a new Nintendo account for eshop / internet update access and then put the console into airplane mode.
4. I went ahead and went through the TX OS setup process doing the process thru the website to get my license file to prevent the console from ever being online in TX OS mode.
5. Booted into TS OX custom firmware while in airplane mode and played a few minutes of a non updated "backup copy" of Kirby Allstar Allies...game works as intended.
6. Shut console down and booted up into OFW, took the console out of airplane mode and updated Kirby via the menu select option. Update completed. Put console back in airplane mode.
7. Went back into TX OS CFW and played a few more minutes, can confirm the update took as expected.

This is the cleanest possible way I could imagine to do this process while eliminating any other scene variable. No homebrew ever launched, no auto rcm, no layered FS ect ect.
I intend to do this with a lot more games when my much larger 256gb card arrives today. I will keep you all updated on the outcome.

Also I just wanted to take a quick minute to thank you all for the interesting reading over the past few months and the work going into this scene. Once a lurker now a poster I suppose.

5.x.x has better telemetry tools, if you were anything lower than 5, you should have stayed there.

This is both interesting and relatively easy to test. Just have an empty SD card, don't try to put anything on it while running the Switch, and see if the empty space decreases. Although not sure how legal of a scenario that is...

Do you mind filling out the form? Makes it easier for me and everyone else to track your progress rather than deciphering your actions. Please and thank you.
but cant you downgrade without burning any fuses?
Only if you have a NAND dump that matches the current number of fuses burnt AND if you updated beforehand using either Hekate/SX OS.

I used it only once to test out a game. It crashed on me and I gave up. Wasn’t worth the annoyance. I did do a lot of emulator playing.

I’ve done a lot with my banned second switch including messed with Linux. The console was offline until today (cleared logs, formatted, never went online with cfw or ofw. Always had airplane mode on until today. I did go only with Linux, though.)

I’ve also used my first switch (before I got my second one for hombrew use) for only a couple of emulators a couple of weeks back. It doesn’t seem to be banned.

Couldn't this also be some misc data that the switch writes? If we know what log files are (File ext) then we could see if this is the case pretty quickly.

I’ve also used my first switch (before I got my second one for hombrew use) for only a couple of emulators a couple of weeks back. It doesn’t seem to be banned.

When you said that you went online today, is this on the CFW you went online on or with OFW?

You just answered not clearing your logs prior to going online but indicated in your comment that you did clear logs. If you did clear logs, what firmware were you on?

That's what I'm saying. It would be a really easy thing to test. But given that this involves Nintendo reading files off your SD card, I'm not sure how well that would fly in court. Not to mention, what happens if your SD card is full?

That's true, but what I mean is that they could store logs or some sort of CFW identifier in the Nintendo folder at the SD. Not actually reading off it if it has CFW files.
