LayeredFS seems to be a big trigger. Many people who reported that they have been banned have used LayeredFS, at least once. It's for sure not the only trigger since some people didn't use it and were still banned.
Generally, bans don't restrict offline functionality, so it should still work. No, you don't need an internet connection for local multiplayer.

Reminds me of M$ with the profile corruption and shitz that they only stop until they lost on court so they updated the console and gave all features back on a banned console :)

In fact I wouldnt even be surprised if later Nintendo adds a check flag for locking offline connection between banned Switches after one of them is banned so that local gaming gets locked, I bet a lot of ppl would run buy another one and never connect it online ever again so they can play local between friend's switches...

why they can't? because of being afraid loosing on court? I hope they never do some shit like that later on a newer FW...

Though even if they did most likely with a CFW we could probably bypass it likt the crap M$ local ping limit which sucked so much on the X360, but after hacking we could bypass it.

Go online only in OFW and report back, please.

Been doing just that. Actually I had CFW connect to wifi once without realizing it shared internet connections with OFW. Immediately turned it off without loading a game, and updated everything via OFW. No ban here.

Nothing is against the law if you accepted their ToS. Actually one clause of the ToS is that you give up your right to sue Nintendo and can only use arbitration.
Those "no sue" clauses are notoriously difficult to enforce, but save yourself the hassle and don't bother. Nearly everyone would lose. Using unique certs for practically every shread of content makes it easy for them to prove their actions just, so they have every right to protect their partners intellectual property via their platform security.

You'd literally have to pull a rabbit out of a hat by proving you own the cartridge with the cert that you were banned for using to have any chance of winning such litigation.

In the same way you'll be kicked out of a restaurant for being offensive to staff, regardless of whether you've finished a meal you may have already paid for, they can block you from accessing their network.

The fact that they appear to be allowing banned parties re-download previous purchases via the web is a good-guy move to be honest.

Its against the law to cripple the hdd of customers because of banning the console, thats what microsoft did and that is illegal, they can remove you from their services but they cannot damage your console

Not everyone wealthy like you. Honestly though. I do support the fact that people are paying the developers. Of course, but I also see the world differently. They do deserve the money but i feel like the poor people like myself should get to experience the art these developers created. I love Mario games but i can't afford them games. If i was wealthy i would of paid. Then there's also creators who develop games and animations like a boss and get zero money. This is why I don't feel all too guilty because not everyone can even get a cent for their amazing creation. This is my personal reason. Sorry for saying ''lol you actually pay for games'' but I'm glad there's still people like you O:

I was banned no matter how you play nintendo will give you with the hammer I played alone with the SXOS in airplane mode and even so they gave me a ban

Try to avoid going online at all costs until we know it is safe. Theoretically, you can load backups in CFW then switch to OFW to update them but we cannot say that the Switch logs in crucial data when it is in CFW that can be transmitted when the Switch is in OFW and connects online.
