You can try injecting a Public LocalFriendCodeSeed_B to unban yourself, if those available still work.
If not, which is likely the scenario, wait until a new seed gets dumped

I know, i know this is going to sound stupid and i know. But i got a new new 3ds, and opted out of re linking my nnid and all that.. You think the Nintendhos can still ban the system? Its not like ill be connecting to anything, no street pass or chapokemon battles online..

Sounds not stupid to me. It's not known, what the exact cause for these bans is.

"There have been reports of a wave of bans being handed out to CFW users by Nintendo. To protect yourself, please do the following steps before starting this guide:
  1. Go to System Settings, then “Internet Settings”, then “SpotPass”, then “Sending of System Information”
  2. Disable the “Sending of System Information” option
  3. Exit the System Settings
  4. Go to your Friend’s List (the Face Icon in the top row of your Home Menu)
    • If you receive an error and are kicked out of the menu, the Friend’s List setting is already disabled
  5. Go to the Friend’s List settings, then “Friend Notification Settings”, then “Show friends what you’re playing”
  6. Disable the “Show friends what you’re playing” option
  7. Exit your Friend’s List"

To answer your question: Yes, Nintendo can still ban your system, if you go online. There is always the risk of bans with CFW. A lot of systems got banned, no matter what CFW, version, A9LH, B9S, settings, etc. was used.
NNID linked systems and systems without NNID got banned.

Ahh that makes sense. Eh oh well at least if they ban the console they cant ban my nnid since they wont know its me lol

Where could an individual obtain this seed? Theoretically of course
That chaos site has a thread with them.

It's not known exactly what criteria Nintendo uses to ban. BUT we do know this: Your currently playing title is sent to Nintendo whenever you are online, regardless of what settings you are using. None of what you do while offline is sent to Nintendo. So avoid using .cia homebrew when you are online if you are worried. If you need to use FBI network transfer, or FreeShop, use the .3dsx of them versions loaded through Rosalina set to a legit title. That way they'll only see you as playing the legit title.

problem is not all homebrew is a 3dsx they should just make it so you can just spoof the title that comes up on the friends list with cfw

If you have the source code of an application like this, you can simply change its title id to one of a retail game.

EDIT: You might not even need this, iirc you can unpack and repack cias changing the tid? I might be wrong tho.

I expect that will be coming in the future once it's reasonably sure that Nintendo uses that to ban people.
Many don't care about the bans. I don't, for example, and I'd take running things directly off the Home menu over loading HBL first any day. That and Rosalina has a bunch of issues and can't be disabled, which is one of the reasons why I don't use Luma. As of now, there's no alternative to Rosalina (yet), so...

If you never use the 3DS online, you're effectively banning yourself in the first place.

New hbl has no issues and it launches quickly and never errors on launch which the hax payload one did sometimes. I have all my homebrew in 3dsx and it works fine just using patch arm9 in luma when i want to use luma updater.

Why would i care about online? For the amazing FPS experience? For the team raids? To build with friends? Online on the 3ds doesn't mean shit, big whoop you can trade pokemon. Or visit some dumb ass animal crossing town..

Clearly you never played Mario Kart or Super Mario Maker.

Yea i have on the Wii U/Switch. Why the hell would i want to play on these tiny ass screens. The 3ds is good for one thing only, RPG's..
