UPDATE: Regarding the recent 3DS banwave

It appears that users are being banned from 3DS online services, en masse. There's no direct cause right now, and seemingly no linking factor. This post is meant as an announcement for users, to be wary, and that GBAtemp will keep you updated as soon as more info rolls in. If you have been banned, please post in the thread below, and we will try to keep tabs on the situation. To be extra sure, it can't hurt to turn off your 3DS's wireless capabilities, so you might as well do that for now.

Edit 1: it appears that e-Shop access isn't restricted if you are banned.

Edit 2: A caller to Nintendo reported that the company said this ban is due to "unauthorized software usage".

There are bans happening, they are happening in all regions.
All models in the 3ds family seem to be candidates for banning.
There is no indication they will be anything other than permanent.
A game or DLC may end up being a cause but there is no one game or DLC that ties banned users together.
The cause or causes are as yet unknown, though it does seem to be related to modifications. Reports of unmodified consoles being banned are as yet unproven.
The banning is tied to something you can modify, thus you can unban. Doing it while the causes are unknown is likely only going to burn a working token though.
There are semi public tokens out there, Nintendo knows how to browse a forum as well as you so don't be surprised if they also get banned.
It does not seem to be limited to a given base firmware version, it does not seem to be limited to any one custom firmware type. There is some speculation that older hacking methods are not being hit as hard but nothing to confirm this yet.
The data collection could have happened this morning, or it could have been months in the making.
A simple check to see is checking your friends list, by itself it will not ban you.
Some are turning their wifi off. It is doubtful this will be of much use and being banned does not seem to come with any downsides that wifi being off will not also mimic.
You may have escaped a ban thus far but it could happen at any point. It could be that they stop in the future, it has happened on other consoles, but you would be living in hope rather than any particularly well founded logic.
The bans are done on the side of Nintendo's servers rather than your 3ds so there is also that.

If you hack your devices/games then their online functionality may be troubled. This has been known for decades, Nintendo seems to have finally caught up with that.

HOW TO HELP AVOID BANS (we think)​

If I was to guess from the information we have gathered since the ban wave, it seems likely that they are looking for TitleIDs that don't exist. Homebrew shows up in the activity log as the Download Play app, and fake CIA's show up as just ??????. That last one is what I'm guessing they are looking for.

If you are not banned yet or before you unban yourself, go into your friends list, choose settings, and turn off the option to "show friends what game you are playing." This will prevent you from playing games online with friends, so turn it back on when you wanna game with someone, but ALWAYS keep it off when running custom CIAs. Next, go into system settings -> internet settings -> spotpass, and turn off BOTH options. One is auto download software, the other sends system information to Nintendo. Also, make sure you don't have your favorite title set to something stupid like FBI or any other non-Nintendo CIA.

Its VERY likely that these options are what tipped off Nintendo, but we aren't 100% certain yet. The amount of banned people that had one of these options turned on was over 80% for each. If I was to assume that some of those people overlap, its very possible (but not confirmed) that 100% of banned people in the survey had at least one of those options turned on. I personally had all of them off and I have TONS of reasons for Nintendo to ban me.... yet I am not banned (yet).

Another bit of advice: Only run custom CIAs when offline, and after you close them, run a "legit" game like Smash Bros. or something before shutting down or going back online. This way your most recent title won't show up as a fake CIA

Current Theories as to what causes a ban
* SpotPass Settings: 8 users out of 46 users that were banned have SpotPass completely shut off, or SpotPass only (no friends list visibility)
* Firmware Version (Luma, Nintendo): Literally all reports ranged from 10.2+, I can get exact numbers for this if you'd like, but all firmwares were affected.
* Firmware Type (A9LH, B9S): 44 of the 126 B9S users that answered were banned, pattern was mirrored for A9LH users as well.
* Homebrew Titles such as FBI, HBL, Luma Updater, Themely, and freeShop: Literally about 98% of users both banned and unbanned had some combination of these applications installed. However the common ones were: FBI, HBL, LumaUpdater and NTR.
* Save Modification: Equal amounts of users on both sides have reported save modification in some form, either with PKSM or another save editor
* System Transfers: 188 users said that they had not previously system transfered, 61 of those users were banned; 16 users said they transferred from a hacked console, only three of them received a ban; 13 said they transferred from a stock system and likewise were banned. The rest of our sample did not answer this question.
* Activity Log Information: A majority of those who have not been banned have said they had NOT cleaned their activity logs. I can get exact numbers for this too on request.

This information is just what I've found. Like I said, there could be variables or things we haven't even checked for yet. But these are things that I feel should be disproven, at least with the current dataset we have.

  • From the information that we've gathered from some people that have used a packet sniffer such as WireShark, the following data is sent to Nintendo's online gaming servers as soon as the 3DS connects to the internet:
    • Amount of time spent online (timer stops when either the system is disconnected from the internet, or connection drops out, then starts the timer again in a new session when it reconnects to the internet).
    • The game being played and amount of time spent on it during that session.
    • The console's unique hexadecimal ID used in the LocalFriendCodeSeedB, along with it's RSA-signed signature.
    • The console's serial number in which is broadcasted from the SoC and is hard coded in the SoC.
    • Friend Code generated on the Nintendo 3DS system, if one has been generated.
    • Internet connection status (either online or offline).
    • The Nintendo Network ID, if there is one linked to it.
    • Even if the sending of SpotPass Information is switched off, or even hiding your currently playing games. It does not prevent the system from sending currently playing information to Nintendo's online gaming servers, it only hides it from your friends in your friend list (like being invisible on the forum, while mods and admins can still see you). Why? Because even people without a Friend Code on their system have been getting banned too!

  • The following data is NOT sent to Nintendo's online gaming servers:
    • The data from the Nintendo 3DS's Activity Log. Oddly enough, while Nintendo does explicitly state that they collect Activity Log data, they're actually referring to their own server's Activity Log, which always tracks every console's online activity, and keeps a record of them that is stored forever. And is only collected in increments of data through a timer and a currently playing list.
    • Games or apps that have not been played, regardless if they're legitimate or not. You only get tracked when you're online and using that game or app.
    • Using games or apps while offline. Even though it is stored on the 3DS console's Activity Log, that data is NOT sent to Nintendo's online gaming servers.
    • Custom Firmware. Though we can't rule out the possibility of them releasing a 3DS update in the future that adds such function to collect MD5 hashes of files and FIRM data and send them to Nintendo online gaming servers (which would also be updated in a maintenance).

  • Things that people think what happens with consoles, but really doesn't:
    • "LocalFriendCodeSeedB is transferred to the system upon doing a system transfer". This is false, the LocalFriendCodeSeedB remains on the system and does not move to another system.
    • "The console generates a LocalFriendCodeSeedB upon first startup". Again, this is false, the LocalFriendCodeSeedB is made during the manufacturing process at Foxconn. It is generated at the factory, flashed to the NAND flash memory storage, then created as an account on Nintendo's online gaming server and Nintendo eShop server immediately when being manufactured. It is absolutely impossible to generate a LocalFriendCodeSeedB and be able to connect to Nintendo's online gaming server and/or Nintendo eShop server, even if you knew the RSA generation key for it. You'd end up with Error Code 002-0102 "This console's online services have been restricted by Nintendo" if you even tried (the error can either mean two things: The hexadecimal ID doesn't exist on the server, or the request to access the hexadecimal ID has been denied which in other words... banned). So a LocalFriendCodeSeedB generator will NEVER happen! Because it's not worth doing, if it can't connect.
    • Switching off "Currently Playing" information. Once again, this does not hide your online activity from Nintendo's online gaming server, it only hides it from your friends.
    • Switching off SpotPass. Nope, this too doesn't hide your online activity from Nintendo's online gaming server, it only opts-out of receiving SpotPass data, sorry.

So pretty much the bottom line is, if anyone has been using custom apps and/or titles not installed through Nintendo eShop while online in the past, guess what? You're screwed! And it is only a matter of time before your console's unique hexadecimal ID in the LocalFriendCodeSeedB is banned from Nintendo's online gaming server. This will mean, your console can't access the Friend List or play any online functions in games.

If you have been online while using custom apps and/or titles not installed through Nintendo eShop and haven't been banned yet, that's because Nintendo hasn't caught up to you yet. They're still going through each unique hexadecimal ID's Activity Log on their server, and by Activity Log, I mean the Activity Log on their server, not the 3DS console's activity log. And it will be only a matter of time before you're banned too.

Use your brain, thanks. Installing illegitimate is the easiest and most realistic way of how they checked for CFW, but the bans could be completely random or depening on what you had installed on which day and if you were online.

Just because you werent bans for CIAs, doesnt mean it's not important, the world doesnt revolve aroung you.

Me, Nitro, Veranek, You and others are all on the same page. We had already looked at those titles days ago and found no correlation. Calm down :) We understand.

I just checked on my N3DSXL with 11.4 + B9S. I dind't get any error from going to friendlist so seems im not banned.

I pretty much never go online with it (as in wifi on but not using online functions of games), only like twice before with an original MK7 cartridge.

4th day still no ban for me. Safe to say there hasn't been any new banning I guess. Gotta wait for the next wave.. see if I get hit as well.
I'm turning on spotpass on, and leaving it on sleep mode when i'm not playing. I'm just doing regular stuff like I always have before the ban wave, just gonna see if it get the hammer.

Regarding eShop purchases, there has been reports of people getting banned even when they bought games. Discussed about it yesterday.
For my case, I have quite a bunch of purchases, cuz I don't pirate games besides using NTR CFW for streaming reasons.
I did the same thing you want to attemp but it just updated my console now I'm on 11.4 an still Can play online games

While Freeshop and Luma Updater are recent to my system, I've had FBI and Homebrew Launcher on my system for probably literally over a year at this point, and all this time it's been sending info to Nintendo. I never bothered to turn Spotpass off; I've never told it not to send info to Nintendo. It's been powered on and (mostly) in sleep mode for weeks; it's gotten Spotpass software, notifications, the works.

This means one of the following is probably true:
  1. It's not homebrew CIAs, it's something else. I'm fairly convinced of this since there's plenty of people on here who've also mentioned they've got homebrew CIAs on their systems and they didn't get banned. For your theory to still work with this, you'd have to convince me Nintendo would only ban random people who met that criteria - and frankly, what do they gain by doing that? Absolutely nothing.
  2. It's Luma Updater, and it must've been collected over a month ago (as I didn't bother A9LHing my 3DS until I got my Switch at the start of this month; before then I was using EmuNAND and ReiNAND). Maybe it's another one entirely - but I doubt it, given we would've probably figured out if it was a specific homebrew by now.

For me I got this console banned before so I figured it to be a second offense punishment, but they never brought up the previous time, and I read others getting permabanned and it's their first offense.

I have a question about sleep mode. Really? I put my consoles in sleep mode a lot, it shaves time in getting to gen requests, without having to leave the console open and have it plugged into the charger. I'm thinking about efficiency and battery life at the same time. At the time of banning, my main console was plugged in for a while, charging and awaiting any genning requests. Since then I've done the sleep mode thing more, thinking that since it cuts off internet, that no data would be send, and I have Spotpass disabled anyways.
Correct me if I am wrong but... you DO KNOW that you can put your console to sleep mode (Closing the lid) and still download shit, right? So putting your 3ds' to sleep does NOT cut off the wi-fi.

2 out of 3 sytems have not yet been banned
  • 2DS 11.4 boot9strap and luma3ds
  • O3DS XL 11.4 boot9strap and luma3ds
  • N3DS XL 11.4 boot9strap and luma3ds (haven't checked cause im scared lol)
all have the shop that is free, recently updated to boot9strap ,used jksm and pksm many times, played pokemon moon online yesterday morning, have ntr cheats, installed legit and not legit cias, used ciangel, used tikdevil, used tikshop, never downloaded games from eshop, been checking both my 2ds and o3ds every hour. hopefully this helps with what may be causing the bans, if you need anymore info on what i have im more than happy to provide it. stay safe everyone

edit - I never used any kind of cheats or mods online and all my systems are still not banned will update if anything happens

update 1: All three systems still havent been banned, been going online with all of them in pokemon SuMo and MK7. Have all the settings off like spotpass off and cant see what im playing

Correct me if I am wrong but... you DO KNOW that you can put your console to sleep mode (Closing the lid) and still download shit, right? So putting your 3ds' to sleep does NOT cut off the wi-fi.
Holding the power button as if you were to power down normally will bring up what is still active in sleep mode.

So, again, MOST LIKELY Nintendo checks for unknown titleIDs (installed titles, activity logs, friendlist) since they A. can't detect A9LH/B9S and B. CFW itself is harder to check for than titles.

LumaUpdater is an illegitimate title too, idiot, EXACTLY WHAT I AM TALKING ABOUT.

Also, "People whose systems had [x,y,z] during periods [a,b,c]", unless you have a better theory you can't just tell others they are wrong because it didnt hit YOU, you nulled nothing. Your theory is "I didn't get hit by it, that's why it can't be CIAs"

Every theory has flaws, that's why we call them theories and not facts, dumbfuck.

Please, he's not trying to say that it IS homebrew CIAs. We've ALL had Homebrew CIAs or some type of illegitimate CIA installed at some point. The godly guide even has us install them. We've already noticed that a lot of the data reported here showed them, Nitro has already agreed but you're the one coming off as the smug prick by not:

1) Searching previously to see that we've already looked into Homebrew CIAs and have found no correlation, this includes NitroBW here.

2) Kindly re-reading.

Now, we've been dealing with a lot of shit trying to keep this thread on topic and not spinning like a wheel in the sky. Tensions are high. But this thread is 366+ pages now? We've been over the hypothesis of CIAs and have discredited at least the titles common to everyone's 3DS consoles.

As for it being ALL CIAs, you don't know that. Nintendo may be looking for specific IDs, we've ruled out the specific ones you've mentioned, but there are thousands of others in the 3DS software library that could've been looked for, if any. I'm not saying that they were, I'm saying it's a possibility that can't be ignored unless we as a community literally go over every single 3DS title as a whole, which is both unlikely to happen and very unreasonable to ask everyone to do.

I've had Homebrew CIAs on my 3DS, in some way, shape, or form, for over a year now, and several of the "big ones" for at least the last 3-ish months - so either they're very specific about what Homebrew they're banning for (and if it were Luma Updater, I'm sure we'd have figured that out by now), the data they are going off is old as shit (which is false when some people who jailbroke their 3DSes after buying them a few weeks ago also got hit), or it can't be any of those CIAs. Maybe it's another one entirely - but I doubt it, given we would've probably figured out if it was a specific homebrew by now.

As far as I can tell, I've nulled your hypothesis.

Now quit being a know-it-all, and instead of attacking me, spend more time on refining your hypothesis. It's a nice write-up, but it's also so general it's easy to prove wrong.

Correct me if I am wrong but... you DO KNOW that you can put your console to sleep mode (Closing the lid) and still download shit, right? So putting your 3ds' to sleep does NOT cut off the wi-fi.
I had everything included. Sending data for nintendo, friends. The console lay in sleep mode at night. Have been installed freeshop, fbi, Zelda (with a fan translation into Russian). I turned off the wifi when leaving the house. Not blocked.

I feel like the next logical step is to go.. more complex in a way with polling.

If we could get everyone to fill out a form that asked you if you were banned, or not, and to list every installed CIA on your system and any you can remember from the past(Games + Custom titles), then even further by asking what they have done with online play on those games. Oh, and if you had ever transferred a different seed into your system at some point before this wave.(To eliminate them from the data, cause it would take one person using that seed to screw the rest over)

If this is anything coordinated by Nintendo(Who has yet to say they even banned anyone publicly), I'm going to assume it has to do with people using modified saves/cheats for online play, going online with an unreleased game, or custom tracks you normally couldn't make on MK7. Either they were reported by another player, joined a friend who had a modified track, or one hit-KO'd someone with a cheat that raised a red-flag.

TL;DR - It doesn't appear to be any solo CIA or setting, so I believe this will determine if it's anything to do with online interactions across multiple games/cias.

You could backup the N3DS' seed from the movable.sed (afaik) and use it. Swapping the seed won't mess up anything.

Could always extract both the in-use seed and the one from that movable.sed file (wherever that is) and see if they're different

(Also I still would like to know if System Updates, Mystery Gifts in Pokemon, and the Theme Shop are affected by the ban...)

I second this. It certainly looks like it could be a mixture of factors, or perhaps something else entirely. May even be a single factor that we're missing because we aren't being thorough enough in polling. But just because a small subset of CIAs are in common, does not mean that (CIAs in general) aren't a factor. :P

Making a public poll seems useless when it gets relinked and people that might not have read the original instructions contribute. It would be better if a handful of people polled others in private, even a hundred combined sample sizes would give an idea of what's happening.
