Now is as good of a time as any. This will certainly not be the only ban wave and when installing CFW that is just one of the risks you have to accept. It won't be any less risky to install it in the future.

tl;dr: You'll need a (legit) DSiWare game on the hacked 3DS. A lot of them will work, there's a long list on that page. Once that's done you need to inject the Sudoku DSiWare over the legit title and install dsiwarehax onto it. Then you can transfer onto the non-hacked 3DS which will transfer the injected game with dsiwarehax.
I know the guide by heart now. My 3ds is on 2.2.0 and can't use carts(cart port be dead as a doddo) so only option is hardmod for me. No dsi games... flock
